Resumen
El presente escrito pretende realizar un análisis a la gestión administrativa del alcalde José Miguel Bonilla Castiblanco, frente a la transferencia de bienes públicos en sus diferentes naturalezas jurídicas, mediante la adjudicación de estos predios, como una solución eficiente a contribuir con el acceso a una vivienda digna, entendiéndose a esta como el derecho que se le asiste a todo colombiano como un elemento esencial del concepto de hábitat y, además, como un requisito indispensable en la lucha contra la pobreza, que desde el ordenamiento jurídico ha asignado un papel protagónico a los municipios en la promoción, protección y garantía del derecho a una vivienda digna. De tal manera que lo descrito durante el recorrido de la presente investigación tiene la intención de contribuir en el desarrollo y definición de políticas públicas de intervención en el Municipio por parte de las futuras generaciones administrativas y así lograr su manejo eficiente en la defensa de los intereses de las comunidades más vulnerables. Por lo anterior, se planteó para el desarrollo de la invitación el siguiente objetivo principal: Analizar los mecanismos e instrumentos utilizados en la aproximación a la solución de vivienda digna en el municipio de Los Patios, durante la gestión del alcalde José Miguel Bonilla Castiblanco. Por lo tanto, fue necesario proponer los siguientes objetivos específicos: I) Examinar las gestiones administrativas, jurídicas y políticas, utilizadas por el alcalde municipal José Miguel Bonilla, para la solución a la satisfacción de vivienda digna. II) Destacar las gestiones administrativas, jurídicas y políticas, utilizadas por el alcalde municipal José Miguel Bonilla, para la solución de vivienda digna. III) Inferir sobre los instrumentos y mecanismo utilizados para la solución de vivienda digna en el municipio de Los Patios. La investigación se centra en la indagación basada en el modelo histórico hermenéutico o interpretativo que puede entenderse como el proceso por el cual llegamos a conocer la vida espiritual con la ayuda de signos. Sin embargo, en concordancia con el enfoque cualitativo, se puede evidenciar que un análisis sociojurídico debe realizarse desde un contexto específico, en este caso el referente es la ciudad de Los Patios. Para permitir un abordaje adecuado del problema, se ideó un método hermenéutico dialéctico, con el objetivo de encontrar el sentido de las cosas, aclarando al máximo los gestos de las letras, conservando en general su especificidad. Dicho lo anterior, la técnica aplicada en la presente investigación será de tipo documental, y para ello se contará con la utilización de fuentes de información obtenida en el municipio. Para los resultados y discusión, se expusieron los resultados encontrados respecto a los objetivos propuestos, clasificando estos en tres categorías: I) El Plan de Gobierno como instrumento propositivo: un examen a los instrumentos políticos para la solución de vivienda digna. II) El Plan De Desarrollo como mecanismo de planificación: un destacamiento respecto a las Gestiones Administrativas y Jurídicas para la solución de vivienda digna. III) Inferencia sobre los instrumentos y mecanismos utilizados para la solución de vivienda digna. Lo anterior permitió generar cuatro conclusiones que proporcionan un análisis importante a las estrategias implementadas por el mandatario de los patienses
The purpose of this paper is to analyze the administrative management of Mayor José Miguel Bonilla Castiblanco, regarding the transfer of public property in its different legal natures, through the allocation of these properties, as an efficient solution to contribute to the access to decent housing, This being understood as the right that every Colombian has as an essential element of the concept of habitat and also as an indispensable requirement in the fight against poverty, which from the legal system has assigned a leading role to the municipalities in the promotion, protection and guarantee of the right to decent housing. In such a way that what has been described during the course of this research is intended to contribute to the development and definition of public policies for intervention in the Municipality by future administrative generations and thus achieve its efficient management in the defense of the interests of the most vulnerable communities. Therefore, the following main objective was proposed for the development of the invitation: To analyze the mechanisms and instruments used in the approach to the solution of decent housing in the municipality of Los Patios, during the administration of Mayor José Miguel Bonilla Castiblanco. Therefore, it was necessary to propose the following specific objectives: I) To examine the administrative, legal and political steps used by the municipal mayor, José Miguel Bonilla, for the solution to the satisfaction of decent housing. II) To highlight the administrative, legal and political steps used by the municipal mayor, José Miguel Bonilla, for the solution of decent housing. III) Infer on the instruments and mechanisms used for the solution of decent housing in the municipality of Los Patios. The research focuses on the inquiry based on the historical hermeneutic or interpretative model that can be understood as the process by which we come to know the spiritual life with the help of signs. However, in accordance with the qualitative approach, it can be evidenced that a socio-legal analysis must be carried out from a specific context, in this case the referent is the city of Los Patios. In order to allow an adequate approach to the problem, a dialectical hermeneutic method was devised, with the objective of finding the meaning of things, clarifying as much as possible the gestures of the letters, preserving in general their specificity. Having said the above, the technique applied in the present research will be of documentary type, and for this purpose, the sources of information obtained in the municipality will be used. For the results and discussion, the results found with respect to the proposed objectives were presented, classifying them in three categories: I) The Government Plan as a propositional instrument: an examination of the political instruments for the solution of decent housing. II) The Development Plan as a planning mechanism: a highlighting of the Administrative and Legal Management for the solution of decent housing. III) Inference on the instruments and mechanisms used for the solution of decent housing. The above allowed the generation of four conclusions that provide an important analysis of the strategies implemented by the president of the patienses.
