Resumen
La investigación "Análisis del recrudecimiento de la pena en delito de homicidio a la luz de la ley 599 del 2000." analiza cómo el endurecimiento de las penas refleja un enfoque reactivo frente al delito, buscando disuadir actos criminales graves.
Se revisan los aumentos de las penas establecidos por esta ley y posteriores reformas, así como las tensiones entre estas medidas y las obligaciones internacionales en derechos humanos adquiridas por Colombia. Se examina actitudes sociales y legislativas, un enfoque punitivo que, en lugar de buscar la resocialización del delincuente, parece estar orientado hacia el castigo severo. Esta investigación utilizó un método cualitativo bibliográfico documental, en donde se precisó una sistematización que integró todo lo recopilado en la búsqueda en bibliotecas especializadas.
En última instancia, el trabajo busca contribuir al debate sobre la política criminal en Colombia, proponiendo un cambio de paradigma que priorice la prevención y la reinserción social sobre el simple castigo. Se concluye con el recrudecimiento de la pena de homicidio en Colombia ha sido una respuesta legislativa a la problemática de la violencia, pero su efectividad es limitada.
Aunque se busca disuadir el delito mediante penas más severas, este enfoque no aborda las causas estructurales de la criminalidad ni cumple plenamente con los principios de proporcionalidad y rehabilitación exigidos por los estándares internacionales de derechos humanos.
El impacto es complementar estas medidas con estrategias integrales de prevención, fortalecimiento institucional y justicia restaurativa con una reducción efectiva de violencia y respeto a los derechos fundamentales.
The research "The increase in the penalty for homicide in Colombia since the entry into force of the Penal Code (Law 599 of 2000)" analyzes how the hardening of penalties reflects a reactive approach to crime, seeking to deter serious criminal acts. The increases in penalties established by this law and subsequent reforms are reviewed, as well as the tensions between these measures and the international human rights obligations acquired by Colombia. Social and legislative attitudes are examined, a punitive approach that, instead of seeking the resocialization of the offender, seems to be oriented towards severe punishment. This research used a qualitative bibliographical documentary method, where a systematization was specified that integrated everything collected in the search in specialized libraries. Ultimately, the work seeks to contribute to the debate on criminal policy in Colombia, proposing a paradigm shift that prioritizes prevention and social reintegration over simple punishment. It is concluded that the tightening of the homicide penalty in Colombia has been a legislative response to the problem of violence, but its effectiveness is limited. Although it seeks to deter crime through harsher penalties, this approach does not address the structural causes of criminality nor does it fully comply with the principles of proportionality and rehabilitation required by international human rights standards. The impact is to complement these measures with comprehensive prevention strategies, institutional strengthening and restorative justice with an effective reduction of violence and respect for fundamental rights.
