Resumen
El acuerdo de paz sentó un hito histórico en Colombia y reconoció la perspectiva enfocada en el género en el proceso de Justicia Transicional, acreditando la calidad de víctima a las mujeres excombatientes otorgándoles un trato especial en papel, letras que se escriben en documentos pero se evaporan en la práctica, creándose la necesidad de
sensibilizar sobre la importancia de una reparación con no revictimización, por tanto, se propone analizar las dinámicas de las violencias basada en género (VBG en adelante)
interfilas en el conflicto armado colombiano desde una perspectiva constitucional feminista, a través de una revisión sistemática para la sensibilización y visibilización en
los marcos jurídicos e institucionales. Por lo anterior, se plantea la sistematización de instrumentos nacionales e internacionales en aras de construir un lazo social libre de
silencio y prejuicios, exigiendo la presencia e intervención del Estado, la seguridad institucional y jurídica en el marco del post-acuerdo, con base en un enfoque naturalista
y cualitativo, con método descriptivo de corte transversal que dé cuenta de las fisuras y barreras de la aplicabilidad de los instrumentos jurídicos nacionales e internacionales.
The peace agreement set a historic milestone in Colombia and recognized the gender focused perspective in the Transitional Justice process, accrediting the quality of victim to female ex-combatants by granting them special treatment on paper, letters that are written in documents but evaporate in practice, Therefore, it is proposed to analyze the dynamics of gender-based violence (hereinafter GBV) in the Colombian armed conflict from a feminist constitutional perspective, through a systematic review to raise awareness and visibility in the legal and institutional frameworks. Therefore, the systematization of national and international instruments is proposed in order to build a social bond free of silence and prejudice, demanding the presence and intervention of the State, institutional and legal security in the post-agreement framework, based on a naturalistic and qualitative approach, with a cross-sectional descriptive method that accounts for the fissures and barriers to the applicability of national and international legal instruments
