Resumen
A partir de la crisis que ha vivido el Estado Venezolano, especialmente desde el año 2015, con el cierre de la frontera con Colombia, una gran cantidad de ciudadanos de dicho país han migrado, buscando tener una mejor calidad de vida. Debido a su ubicación geográfica, la ciudad de Cúcuta, en la frontera nororiental de Colombia con el vecino país, se ha convertido en uno de los territorios que más migrantes ha recibido. Este hecho ha traído consigo un aumento en las cifras de desempleo, a la vez que ha significado una problemática para los migrantes venezolanos, especialmente porque se les ha dificultado acceder a fuentes laborales legales en el territorio colombiano y gran parte de dicha dificultad se ha centrado en la imposibilidad de muchos venezolanos para obtener los documentos que deben presentar y que son esenciales para poder acceder a los diferentes programas que tiene el Estado en este aspecto. Teniendo en cuenta esto, el objetivo general del presente ensayo es analizar, desde una perspectiva doctrinal y jurídica, la situación de vulnerabilidad laboral en la que se encuentra la población migrante venezolana residente en la ciudad de Cúcuta, Colombia. Como conclusión, se destaca el esfuerzo que ha tenido el Estado colombiano para establecer mecanismos que favorezcan a esta población.
Due to the crisis experienced by the Venezuelan State, especially since 2015, with the closing of the border with Colombia, a large number of citizens from that country have migrated, seeking a better quality of life. Due to its geographical location, the city of Cucuta, on the northeastern border of Colombia with the neighboring country, has become one of the territories that has received the most migrants. This fact has led to an increase in unemployment figures, while posing a problem for Venezuelan migrants, especially because accessing legal employment opportunities in Colombian territory has been challenging for them. Much of this difficulty has revolved around the inability of many Venezuelans to obtain the necessary documents, essential for accessing various programs offered by the State in this regard. Taking this into account, the general objective of this essay is to analyze, from a doctrinal and legal perspective, the labor vulnerability of the Venezuelan migrant population residing in the city of Cucuta, Colombia. In conclusion, the essay highlights the efforts made by the Colombian government to establish mechanisms that benefit this population.
