Resumen
El presente artículo tuvo como propósito principal el demostrar el poco conocimiento de la figura del Estado de Cosas Inconstitucional con el fin de brindar una nueva forma de observación y conceptualización generada desde un análisis jurisprudencial y referentes teóricos, que desarrollaron este tema desde la visión derecho constitucional; lo anterior mediante la metodología cualitativa desarrollada a través del método dialectico propuesta por el autor Miguel Martínez Miguélez sobre la cual se extiende en la utilización un paradigma hermenéutico interpretativo teniendo como una referencia el desarrollo jurisprudencial realizado por ala Honorable Corte Constitucional. Sin embargo, para establecer una posible solución sobre el tema en cuestión se analizaron 8 sentencias las cuales desarrollan el concepto objeto de esta investigacion obteniendo como resultado conclusiones donde se aprecian lo siguiente; la equidad, la igualdad y la equidad de genero son tres conceptos diferentes pero complementados entre si donde su aplicación fuera de manera correcta en la sociedad garantizaría una mejor calidad de vida, se establecieron los parámetros que determina la corte para la configuración del E.C.I, también se pretendió establecer una formula para superar el Estado de Cosas Inconstitucional.
The main purpose of this article was to demonstrate the lack of knowledge regarding the figure of the Unconstitutional State of Affairs, in order to provide a new way of observation and conceptualization generated from a jurisprudential analysis and theoretical references developed on this topic from a constitutional law perspective, through a qualitative methodology developed using the dialectical method proposed by author Miguel Martínez Miguélez, based on a hermeneutic-interpretative paradigm having as a reference the jurisprudential development carried out by the Honorable Constitutional Court. However, in order to establish a possible solution on the subject in question, 8 sentences were analyzed which develop the concept studied in this investigation, resulting in conclusions where the following is observed: equity, equality, and gender equity are three different but complementary concepts, whose correct application in society would guarantee a better quality of life. The parameters that the Court determines for the configuration of the U.C.I were established, and it was also intended to establish a formula to overcome the Unconstitutional State of Affairs.
