Análisis del sistema penitenciario y carcelario en Colombia como estado de cosa inconstitucional en la resocialización de la población privada de la libertad

Resumen
El hacinamiento en los establecimientos penitenciarios y la alarmante ausencia de
infraestructura apropiada para cumplir con los fines resocializadores de la pena, ha
aumentado en Colombia. La Corte Constitucional ha declarado en tres oportunidades la
existencia de un estado de cosas inconstitucional en las cárceles del país. A mayor
hacinamiento, la calidad de vida de los reclusos y la garantía de los derechos humanos
y fundamentales es menor. Por lo tanto, este fenómeno ha representado para los
reclusos una pena adicional a la judicialmente impuesta, que ha generado una situación
de tratos crueles, inhumanos y degradantes. Laausencia de personal especializado ha
contribuido a agravar la ya de por sí preocupante realidadque enfrentamos. Estos factores
han puesto en riesgo la garantía de los derechos fundamentalesde los reclusos, haciendo
casi imposible que se pueda cumplir con la finalidad del sistema. La crisis carcelaria va
más allá del hacinamiento. La problemática carcelaria y penitenciaria requiere de la
voluntad política, sincera y decidida, que incursione de una vez por todas en una
verdaderapolítica criminal de alter natividad penal propia de un Estado social de derecho
establecido en laConstitución Política. A mayor política Social, menor política criminal. El
presente artículo, analizó la Situación Penitenciaria y Carcelaria en Colombia, como
estado de cosa institucional, proponiendo alternativas de solución y fue elaborado basado
en un Paradigma Interpretativo con enfoque cualitativo, desarrollando investigación
hermenéutica, utilizando técnicas de recopilación de Información de Análisis Documental y técnicas de análisis de
información categórica.
Overcrowding in prisons and the alarming absence of adequate infrastructure to fulfill the resocializing purposes of the sentence has increased in Colombia. The Constitutional Court has declared on three occasions the existence of an unconstitutional state of affairs in the country'sprisons. The more overcrowded, the lower the quality of life of prisoners and the guarantee of human and fundamental rights. Therefore, this phenomenon has represented for prisoners an additional penalty to that judicially imposed, which has generated a situation of cruel, inhuman and degrading treatment. The absence of specialized personnel has contributed to aggravating the already worrying reality we face. These factors have jeopardized the guarantee of the fundamental rights of prisoners, making it almost impossible to fulfil the purpose of the system.The prison crisis goes beyond overcrowding. The prison and penitentiary problems require the political will, sincere and determined, which ventures once and for all into a true criminal policy of penal alternativity typical of a social State based on the rule of law established in the Political Constitution. The greater the social policy, the less criminal policy. In this article, the Penitentiary and Prison Situation in Colombia was analyzed, as a state of institutional affairs, proposing alternative solutions and was elaborated based on an Interpretative Paradigm with a qualitativeapproach, developing hermeneutic research, using techniques of collection of Information of Documentary Analysis and techniques of analysis of categorical information.
