Resumen
Antecedentes:
El Derecho Disciplinario en Colombia ha sido en los últimos tres años, en afianzamiento
del derecho al debido proceso, enlazando las recientes reformas normativas, contenidas
en las Leyes 1952 de 2019 y 2094 de 2021, que entrarán en vigencia cabalmente el 29
de marzo de 2022.
Objetivos: En este artículo se evidenciaron principios procesales tales como la doble
instancia, la doble conformidad y el principio acusatorio, donde un funcionario presto sea
el que investigue, y otro funcionario neutral sea el que juzgue al disciplinable.
Materiales y Métodos: La investigación fue realizada bajo un esquema procesal, la
norma prevé que las Personerías Municipales deben asegurar el cumplimiento de estas
garantías procesales y de no poder adaptar su estructura al trámite del nuevo
procedimiento administrativo disciplinario, deberán remitir sus actuaciones a la
Procuraduría General de la Nación.
Resultados: Esta facultad Se basa en la interacción gremial, el derecho disciplinario
quien tiene la garantía primordial de observar en el ejercicio disciplinario, permitiendo
con ello una ponderación de dicha facultad estatal, la cual solo se va a poder realizar
dentro de sus principios rectores de responsabilidad disciplinaria.
Conclusiones: Claramente la potestad en este campo de ejercer un control disciplinario
sobre sus servidores, el debido proceso y el derecho a la custodia, con lo que se
consiguió una armonización entre los objetivos fundamentales del Estado y la custodia
de los derechos constitucionales de los disciplinados.
Background: Disciplinary Law in Colombia has been in the last three years, in strengthening the right to due process, linking the recent regulatory reforms, contained in Laws 1952 of 2019 and 2094 of 2021, which will fully enter into force on March 29, 2022. Objectives: In this article, procedural principles such as double instance, double conformity and the accusatory principle were evidenced, where a ready official is the one who investigates, and another neutral official is the one who judges the disciplinary. Materials and Methods: The investigation was carried out under a procedural scheme, the rule provides that the Municipal Personerías must ensure compliance with these procedural guarantees and if they cannot adapt their structure to the processing of the new administrative disciplinary procedure, they must submit their actions to the Attorney General's Office. General of the Nation. Results: This faculty is based on union interaction, disciplinary law who has the primary guarantee of observing in the disciplinary exercise, thereby allowing a weighting of said state faculty, which will only be able to be carried out within its guiding principles of disciplinary responsibility. Conclusions: Clearly the power in this field to exercise disciplinary control over its servers, due process and the right to custody, with which a harmonization was achieved between the fundamental objectives of the State and the custody of the constitutional rights of those disciplined.
