Resumen
Este proyecto tiene el propósito de abordar el análisis de la violencia hacia la mujer desde la responsabilidad del Estado frente a la aplicación del sistema penal en Colombia, así mismo, se realizará una observación normativa y jurisprudencial vigente en el ámbito de violencia hacia la mujer. Es pertinente reconocer el vínculo entre los funcionarios públicos y la violencia ejercida institucionalmente sobre las víctimas, ya que este fenómeno plantea un reto constante para las entidades estatales encargadas de velar por el respeto de Derechos. Su aplicación efectiva continúa siendo un desafío, especialmente cuando las víctimas intentan acceder a procesos judiciales justos y libres de revictimización. Respecto al método de estudio de la investigación, parte desde un enfoque cualitativo, que resulta pertinente dada la naturaleza compleja y profundamente humana de la violencia contra la mujer. Esta problemática no puede ser comprendida únicamente a partir de cifras o indicadores, ya que involucra realidades vividas, experiencias personales, contextos culturales y dinámicas institucionales que requieren una mirada comprensiva y reflexiva. Desde esta perspectiva, la metodología cualitativa permite indagar los significados que las víctimas le asignan a sus vivencias, así como las percepciones sobre el actuar del Estado, especialmente en lo relacionado con el sistema penal y su respuesta frente a los incidentes sobre violencia basada en género. Se privilegia el testimonio como herramienta para visibilizar patrones de revictimización, omisiones en la atención institucional y fallas estructurales que perpetúan la impunidad.
The purpose of this project seeks the analysis of violence against women from the point of view of the responsibility of the State in the application of the criminal system in Colombia; likewise, a normative and jurisprudential observation will be made in the area of violence against women. It is pertinent to recognize the link between public officials and the violence exercised institutionally on the victims, since this phenomenon poses a constant challenge for the state entities in charge of ensuring respect for rights. Its effective application continues to be a challenge, especially when victims try to access fair judicial processes free of revictimization. Regarding the methodological basis of the research, it starts from a qualitative approach, which is relevant given the complex and profoundly human nature of violence against women. This problem cannot be explained only from the perspective of the basis figures or indicators, as it involves lived realities, personal experiences, cultural contexts and institutional dynamics that require a comprehensive and reflective view. From this perspective, the qualitative methodology allows us to investigate the meanings that the victims assign to their experiences, as well as their perceptions of the actions of the State, especially in relation to the criminal justice system and its response to incidents gender based violence. Testimony is privileged as a tool to make visible patterns of re-victimization, omissions in institutional attention and structural failures that perpetuate impunity.
