Resumen
Antecedentes: Hoy en día en la sociedad es posible observar como la delincuencia ha aumentado con el paso de los años, y con ello las denuncias de conductas punibles y que quienes la realicen deben ser detenidas, además de la captura de quienes cometen delitos y son acusados y capturados por las autoridades. Para generar una acusación legal y otorgar un castigo pertinente es necesario que las autoridades jurídicas encargadas de realizar la audiencia de legalización de captura, lo hagan conforme a la Constitución Política de Colombia y la legislación. La falta
de denuncia de las víctimas o una inadecuada legalización de captura termina beneficiando a los victimarios. En el código de procedimiento penal, se establece claramente el proceso que se debe cumplir para que la toma de la libertad de una persona no viole los derechos humanos y que el trabajo de las autoridades y de los jueces sea acorde a las funciones que establece el Estado, el no cumplimiento de ellas genera un retraso o cancelación de las audiencias por los fiscales a cargo, quienes cuando reciben los casos tiene el deber de analizar si se cumplió con lo previsto en la norma. Objetivos: Por ello, dentro de esta investigación se propuso como objetivo general analizar las implicaciones que conlleva el proceso de Audiencias de legalización de captura en el sistema penal acusatorio en la ciudad de Barranquilla - Caso Fiscal 52 delegado de Barranquilla Vs. Fiscal Edilberto Corredor Ropero, este caso fue escogido teniendo en cuenta el incumplimiento desarrollado por la fiscalía, verificando que actúan contrario a la ley o realizan una inadecuada comprensión de la legislación, para dar desarrollo a este objetivo general se plantearon tres objetivos específicos, los cuales serán distribuidos en capítulos definiendo el sistema penal acusatorio, exponiendo los principales requisitos de las audiencias de legalización de captura, continuando con el análisis del caso central de esta investigación, detallando los hechos y cuales infracciones se presentaron en el proceso.
Background: Nowadays in society it is possible to observe how delinquency has increased over the years, and with it the denunciations of punishable conduct and that those who carry it out must be arrested, in addition to the capture of those who commit crimes and are accused and captured by the authorities. State, non-compliance with them generates a delay or cancellation of the hearings by the prosecutors in charge, who, when they receive the cases, have the duty to analyze whether the provisions of the norm were complied with. Objective: For this reason, within this investigation it was proposed as a general objective to analyze the implications of the process of Hearings of legalization of capture in the accusatory criminal system in the city of Barranquilla - Fiscal Case 52 delegate of Barranquilla Vs. Fiscal Edilberto Corredor Ropero, this The case was chosen taking into account the non-compliance developed by the prosecution, verifying that they act contrary to the law or perform an inadequate understanding of the legislation, to develop this general objective, three specific objectives were proposed, which will be distributed in chapters defining the accusatory criminal system, exposing the main requirements of the arrest legalization hearings, continuing with the analysis of the central case of this investigation, detailing the facts and which infractions were presented in the process.
