Análisis jurídico de la vulneración del principio de la selección objetiva en los contratos de consultoría y/o interventoría, adelantados en la modalidad selección de mínima cuantía en la contratación estatal

Resumen
La investigación realizada tiene como propósito estudiar la efectividad del principio de la selección objetiva para la selección del contratista, específicamente en contratos adelantados en la modalidad de mínima cuantía, en aquellos casos en los cuales se presentan unos criterios normativos que por su modalidad, permiten la concurrencia con aquellos criterios propios de la modalidad del concurso de méritos; lo anterior teniendo en cuenta que el estatuto anticorrupción (c) así lo permite respectivamente. Ahora bien, esa concurrencia debe entenderse que, en este tipo de contratos, el factor de selección por su cuantía será el menor precio, y la idoneidad y la experiencia se constituyen como criterios habilitantes que la misma norma así lo contempla. Razón por la cual, en primera medida se analizaron los aspectos relacionados con el principio de selección objetiva como pilar normativo de la contratación estatal y su aplicación en la contratación estatal; seguidamente, se identificaron los criterios normativos establecidos en los contratos de consultoría en la modalidad de concurso de méritos; y, finalmente, se analizó en el ordenamiento jurídico colombiano el desarrollo de los criterios de selección objetiva y su aplicación en contratos de consultoría a través de la modalidad de mínima cuantía, de conformidad con los pronunciamientos jurisprudenciales, legales y lineamientos adoptados por Colombia Compra Eficiente, en torno a la concurrencia de los criterios de selección de contratista en este tipo de contratos.
The purpose of the research carried out is to study the effectiveness of the principle of objective selection for the selection of the contractor, specifically in contracts carried out in the modality of minimum amount, in those cases in which there are some normative criteria that by their modality, allow the concurrence with those criteria of the modality of merit-based competition; the above taking into account that the anti-corruption statute (c) allows it respectively. Now, this concurrence must be understood that, in this type of contracts, the selection factor for its amount will be the lowest price, and the suitability and experience are constituted as enabling criteria that the same rule so contemplates. For this reason, first, the aspects related to the principle of objective selection as a normative pillar of government contracting and its application in government contracting were analyzed; then, the normative criteria established in the consulting contracts in the merit-based bidding modality were identified; Finally, the development of the objective selection criteria and their application in consulting contracts through the modality of minimum amount was analyzed in the Colombian legal system, in accordance with the jurisprudential and legal pronouncements and guidelines adopted by Colombia Compra Eficiente, regarding the concurrence of the contractor selection criteria in this type of contracts.
