Resumen
Los daños ambientales que la sociedad campesina, indígenas y afro descendientes en diferentes regiones del país han enfrentado en los últimos años, derivados de la actividad de la minera ilegal, han requerido que los órganos de control y la Defensoría del Pueblo realice una investigación profunda en las distintas zonas del país donde se desarrolla esta actividad, con el objetivo de proteger los derechos fundamentales colectivos e individuales, los cuales se han visto vulnerados por la falta de protección a los mineros tradicionales, como se evidenciara en el desarrollo de esta investigación. Lo que se pretende con los resultados del presente trabajo, es realizar recomendaciones al Gobierno Nacional y a las autoridades locales dirigidas a la protección de los derechos de los mineros tradicionales que ejercen la minería legal en Colombia. Para lograr el objetivo que se quiere llevar a cabo en la investigación se utilizó el método específico, escudriñando información a fondo para poder entender la problemática dada sobre los impactos de la minería ilegal en los diferentes sectores sociales del país, especialmente los de salud y ambiental. Este estudio de carácter específico se obtuvo como resultado del trabajo de investigación y de la interacción con los actores directos que intervienen en la minería tradicional como resultado de un análisis cuantitativo con estadísticas requeridas a las instituciones competentes y de otros informes elaborados por organizaciones que han estudiado del tema.
En el desarrollo de la investigación se analizarán los factores que se deben tener en cuenta para la regulación del amparo administrativo de los mineros tradicionales en desarrollo de actividad minera como protección a sus derechos fundamentales, como son derecho a la vida, la salud, el trabajo, la seguridad y salubridad pública, la prevención de daños y desastres visibles, así mismo, la protección de los recursos naturales y el medio ambiente, los cuales se están afectando por la explotación de la minería ilegal en Colombia y en el mundo.
The environmental damage that peasant, indigenous and Afro-descendant society in different regions of the country have faced in recent years, derived from the activity of illegal mining, have required that the control bodies and the Ombudsman's Office carry out an in-depth investigation into the different areas of the country where this activity takes place, with the aim of protecting collective and individual fundamental rights, which have been violated by the lack of protection for traditional miners, as evidenced in the development of this research. What is intended with the results of this work is to make recommendations to the National Government and local authorities aimed at protecting the rights of traditional miners who exercise legal mining in Colombia. To achieve the objective that is to be carried out in the research, the specific method was used, scrutinizing information in depth to understand the problem given on the impacts of illegal mining in the different social sectors of the country, especially health and environmental . This specific study was obtained as a result of the research work and the interaction with the direct actors that intervene in traditional mining as a result of a quantitative analysis with statistics required from the competent institutions and of other reports prepared by organizations that have studied the subject. In the development of the research, the factors that must be taken into account for the regulation of the administrative protection of the traditional miners in the development of mining activity will be analyzed as protection of their fundamental rights, such as the right to life, health, work , public safety and health, the prevention of visible damages and disasters, as well as the protection of natural resources and the environment, which are being affected by the exploitation of illegal mining in Colombia and in the world
