Inclusión laboral de personas con diversidad funcional en el sector empresarial de la ciudad de Cúcuta: análisis normativo

Resumen
El presente artículo dispuso un estudio significativo dentro de la sociedad global
de la inserción laboral de personas con diversidad funcional, a través del análisis
documental se llevó a cabo un escudriñamiento de diferentes organismos
internacionales que velan por la protección de los derechos humanos,
encontrándose un sinnúmero de documentos que tienen como objeto la
promoción, vinculación, participación, protección y materialización de los derechos
humanos de personas con diversidad funcional dentro del sector empresarial de
Cúcuta. Dicho análisis se basó desde el Marco Normativo del Estado Colombiano,
emanados por las organizaciones de Derechos Humanos ONU, y Organización
Internacional de Trabajo OIT, entidades internacionales que prevalecen los
derechos del colectivo social objeto del presente artículo dentro del plano de
Igualdad. Se realiza un análisis documental que permitió el diseño de una Matriz
de análisis de antecedentes, abordando la Convención sobre los derechos de
estas personas e inclinándose a los Estados Miembros hacia el diseño e
implementación de políticas públicas incluyentes garantizando la participación en
todos los escenarios sociales. Así mismo el artículo se desarrolló dentro de una
metodología de tipo socio-jurídico ya que se tomaron estudios mirando la
normatividad aplicable a los diferentes temas relacionados con personas con
discapacidad, dentro de la perspectiva al método cualitativo ya que fueron
estudios descriptivos que arrojan como resultados el conocimiento de las pocas
garantías que abordan las políticas públicas nacionales para respetarle el derecho
a la igualdad e inserción laboral a la población objeto.
The present article provided a significant study within the global society of the labor insertion of people with functional diversity, through the documentary analysis a scrutiny of different international organizations that ensure the protection of human rights was carried out, finding countless of documents that aim to promote, link, participate, protect and materialize the human rights of people with functional diversity within the business sector of Cúcuta. This analysis was based on the Normative Framework of the Colombian State, issued by the Human Rights organizations ONU, and the International Labor Organization OIT, international entities that prevail the rights of the social group object of this article within the Equality plane. A documentary analysis was carried out that allowed the design of a matrix for the analysis of antecedents, addressing the Convention on the rights of these people and inclining Member States towards the design and implementation of inclusive public policies guaranteeing participation in all social settings. Likewise, the article was developed within a socio-legal type methodology since studies were taken looking at the regulations applicable to the different topics related to people with disabilities, within the perspective of the qualitative method since they were descriptive studies that yielded results knowledge of the few guarantees that national public policies address to respect the right to equality and labor insertion of the target population
