Resumen
El propósito de este estudio fue comprender el desplazamiento forzado por factores ambientales e identificar las acciones jurídicas y rutas de atención existentes de los entes territoriales y nacionales para proteger los derechos de las personas afectadas. La metodología fue cualitativa y jurídica, orientada a analizar el fenómeno desde las dimensiones política, penal y jurídica, así como la normativa internacional, nacional y las políticas públicas relacionadas. Los resultados muestran que, aunque existen avances en la atención a víctimas del desplazamiento por violencia, las personas afectadas por causas ambientales carecen de reconocimiento jurídico, ruta independiente de atención y protocolo de monitoreo específico. Se concluye que es necesario avanzar hacia un marco legal que garantice la protección y reparación integral de estas víctimas.
This study aims to understand forced displacement caused by environmental factors and to identify the legal actions and assistance routes implemented by territorial and national entities to protect the rights of affected individuals. A qualitative and legal methodology was applied to analyze the phenomenon from political, criminal, and legal dimensions, and also through a detailed review of international and national regulations, as well as related public policies. The results reveal that, although there are significant advances in assisting victims of displacement due to violence, those affected by environmental causes still lack legal recognition, an independent assistance route, and a specific monitoring protocol. Therefore, it is concluded that a solid legal framework ensuring comprehensive protection and effective reparation for these victims is urgently needed.
