Resumen
Igualmente, la Constitución admite la posibilidad de la detención preventiva que, conforme al artículo 28 C.P., fuerza en todo caso a que la persona detenida sea puesta a disposición del juez competente, dentro de las 36 horas siguientes, para que éste adopte la decisión que corresponda en el término establecido por la ley.
Además, en el artículo 32 C.P, se permite que en flagrancia el delincuente sea aprehendido por cualquier persona, caso en el cual debe ser llevado inmediatamente ante la autoridad judicial competente. Adicional a este requisito, la ley establece un término perentorio de 36 horas, en donde al individuo se le debe procurar el derecho a la defensa, al debido proceso y garantizársele siempre el respeto por su integridad física, moral, seguido a esto, debe hacerse lectura de sus derechos «Código de Procedimiento Penal, Ley 906 de 2004, Artículo 303» y por último, ser dirigido a un Juez de Control de Garantías que vele por garantizarle el pleno de sus derechos en la investigación y el derecho penal en su contra. En atención a lo anterior, la jurisprudencia constitucional, no ha sido ajena al desarrollo de la figura y de los derechos desprendidos de su aplicación, durante el marco de las acciones de inconstitucionalidad presentadas en contra del texto contenido en el actual Código de Procedimiento Penal.
Likewise, the Constitution admits the possibility of preventive detention which, in accordance with article 28 C.P., forces in any case that the detained person be placed at the disposal of the competent judge, within the following 36 hours, so that he may adopt the corresponding decision within the term established by law. In addition, in article 32 C.P, it is allowed that the offender be apprehended by any person in flagrante delicto, in which case he must be immediately brought before the competent judicial authority. In addition to this requirement, the law establishes a peremptory term of 36 hours, where the individual must be given the right to defense, due process and always guarantee respect for their physical and moral integrity, followed by this, it must be done reading of their rights «Code of Criminal Procedure, Law 906 of 2004, Article 303» and finally, be directed to a Guarantee Control Judge who ensures that they fully guarantee their rights in the investigation and the criminal law against them . In view of the foregoing, constitutional jurisprudence has not been oblivious to the development of the figure and the rights arising from its application, during the framework of the actions of unconstitutionality filed against the text contained in the current Code of Criminal Procedure.
