Resumen
Este trabajo de tesis doctoral, es un estudio que decanta una propuesta, no sin antes, caracterizar el proceso de formación investigativa en los programas de Derecho e interpretar las concepciones y apreciaciones de estudiantes, docentes y directivos, del papel de la formación investigativa en la formación del estudiante de Derecho; y definir los fundamentos epistemológicos, teóricos y metodológicos de la formación investigativa en los programas de Derecho. Pretende poner a dialogar los fundamentos epistemológicos de las teorías: “La pedagogía critica” (Freire), “El Derecho, todo un campo de relaciones” (Bourdieu), “La acción comunicativa” (Habermas), “La investigación acción educativa” (Elliot) y “La formación en competencias” (Tobon), para fundamentar la teoría de la resignificación de la formación investigativa de la práctica a la praxis en los estudiantes de Derecho. Plantea la resignificaciòn de la formación investigativa en los programas de Derecho, presentando una propuesta para desarrollarla desde una visión problémica e interdisciplinar que permita formar al futuro abogado, para el análisis crítico y reflexivo de la realidad social e interpretar el ordenamiento jurídico situándolo como actor y facilitador de los procesos de desarrollo y cambio social.
This doctoral thesis work, is a study and a proposal that characterizes the process of research training programs right from the Caribbean Region and interprets the conceptions and perceptions of students, teachers, directors of the role of the research training in the formation of the student of law and lawyer; and it defines the epistemological, theoretical and methodological foundations of the research training in law programs. Aims to discuss the epistemological foundations of the theories: the right criticizes a whole field of relations (Bourdieu), communicative action (Habermas), pedagogy (Freire), research educational action (Elliot) and training in skills (Tobon) to substantiate the theory of the resignification of the research training of practice to practice. It raises the resignification of the research training in law programmes presenting a proposition to develop research training in law programs, from an interdisciplinary perspective on allowing to educate the future lawyer for critical and reflective analysis of social reality and interpret the legal system by placing it as an actor and facilitator of the processes of development and social change.
