Resumen
El siguiente artículo investigativo tiene como objetivo principal exponer una problemática social que con el paso del tiempo se ha venido incrementado, ya que las víctimas de este fenómeno no tiene voz para hablar, ellas son los animales, o los cuales han sido tomados con simples cosas y no fueron reconocidos como seres vivientes y que sienten y entonces que entre tanto como seres vivientes tiene derecho a buenos tratos que deben ser garantizados por sus dueños o cuidadores. Es evidente que muchas de las personas que tiene en sus casas animales no garantizan su bienestar por lo que sigue latente el fenómeno del maltrato animal y son víctimas de maltrato y les causan daño a estos animales que solo brindan una compañía para el ser humano.
Para el desarrollo de este artículo se investigó toda la evolución y el desarrollo sobre el fenómeno del maltrato animal dentro del ordenamiento jurídico, colombiano, de ello se identificaron los aspectos más relevantes que inciden en la aparición del maltrato animal, así como sus causas y consecuencias, la aplicación de las diversas normas, sentencias que construyeron precedente judicial, acuerdos y leyes que se aplican en Colombia con el objeto de buscar un trato más ético para los animales en el país y penalizar como se debe a quién cause daño a estos seres. Por último se puede decir que en el ordenamiento jurídico respecto a este fenómeno ha evolucionado con el fin de que se vean los animales como seres vivientes que tiene derecho a un bienestar y no a ser maltratados
In the following research article has as main objective to expose a social problem that over time has been increased, since the victims of this phenomenon has no voice to speak they are animals, or which have been taken with simple things and they were not recognized as living beings and they feel and then that as long as living beings they have the right to good treatment that must be guaranteed by their owners or caretakers. It is evident that many of the people who have animals in their homes do not guarantee their well-being, which is why the phenomenon of animal abuse is still present and they are victims of mistreatment, causing harm to these animals that only Brian is a company for human beings. For the development of this article all the evolution and development on the phenomenon of animal abuse within the Colombian legal system was investigated, from which the most relevant aspects that affect the appearance of animal abuse, as well as its causes and consequences were identified. , the application of the different norms, judgments that built judicial precedent, agreements and laws that are applied in Colombia in order to seek a more ethical treatment for animals in the country and penalize as it is due to who causes harm to these beings. Finally, it can be said that the legal framework regarding this phenomenon has evolved in order to see animals as living beings that have the right to well-being and not to be mistreated
