Implicaciones penales derivadas de los delitos contra el medio ambiente en Colombia

Resumen
En Colombia está regulado y tipificado La Constitución Política de 1991 y en la ley 599 del 2000 (Código Penal) los delitos contra el medio ambiente, estos se podría determinar como aquella acción que atente contra el medio ambiente o la naturaleza, este hecho, que acarrean una cadena de sucesos que perjudican el ecosistema y por ende provocan el detrimento del medio ambiente, en este raciocinio un infracción o delito contra el medio ambiente es una transgresión hacia la legislación ambiental.
De este modo abordaremos el tema de los delitos ambientales, desde la perspectiva penal para determinar cuáles son las consecuencias punitivas que se derivan de estos, así mismo estudiaremos el comportamiento de los reincidentes de estos delitos y las zonas con mayor afectación en el país, estudiando las normativas penales y constitucionales.
Para lograr lo anterior realizaremos un análisis jurisprudencial desde la ley 2111 del 2021 y sus antecedentes históricos en el marco del código penal, la ley 599 de 2000 con el colofón de determinar esas consecuencias penales que se derivan de la comisión de los delitos ambientales en Colombia “y la potestad para imponer y ejecutar las medidas preventivas y las sanciones necesarias, frente a las acciones que atentan contra el medio ambiente y los recursos naturales” (Arango, 2020).
Así mismo, La problemática que nos conlleva a analizar la población y las zonas con mayor vulnerabilidad y poder describir cuáles son esas implicaciones que nos determina el código penal.
In Colombia, the Political Constitution of 1991 and in Law 599 of 2000 (Criminal Code) crimes against the environment are regulated and typified, these could be determined as those actions that threaten the environment or nature, this fact, which they carry a chain of events that harm the ecosystem and therefore cause the detriment of the environment, in this reasoning an infraction or crime against the environment is a transgression towards environmental legislation. In this way we will address the issue of environmental crimes, from the criminal perspective to determine what are the punitive consequences that derive from these, likewise we will study the behavior of repeat offenders of these crimes and the areas with the greatest affectation in the country, studying criminal and constitutional regulations. To achieve the above, we will carry out a jurisprudential analysis from Law 2111 of 2021 and its historical background within the framework of the penal code, Law 599 of 2000 with the culmination of determining those criminal consequences that derive from the commission of environmental crimes in Colombia. “and the power to impose and execute the necessary preventive measures and sanctions, in the face of actions that threaten the environment and natural resources” (Arango, 2020). Likewise, the problem that leads us to analyze the population and the areas with the greatest vulnerability and to be able to describe what those implications are that the penal code determines.
