El menor de edad frente a la normatividad penal en Colombia

Resumen
En el presente estudio se analizará el desarrollo normativo que se ha presentado en materia penal, en lo referente al menor de edad, con el cual se ha tratado de dar cumplimiento a los requerimientos hechos por el sistema universal de protección de Derechos Humanos, Especialmente a través de La Convención Internacional De Los Derechos Del Niño, adoptada por Colombia mediante la ley 12 de 1991; principios legales que también quedaron insertos en la Constitución Política de Colombia, que en sus artículos 44 y 45 deja claramente plasmado el reconocimiento de derechos para los niños niñas y adolescentes y especialmente desarrolla como principio orientador el interés superior del niño.
Esta evolución legislativa conllevó a que se creara la Ley 1098 de 2006, que contiene todos los principios y reconocimiento de derechos de los niños, niñas y adolescentes, se crea un gran adelanto frente a la protección de derechos fundamentales de los adolescentes en conflicto con la ley, como el debido proceso y derecho a la defensa; además establece que el proceso deberá garantizar la justicia restaurativa, fundamentarse en ser pedagógico, específico y diferenciado del sistema de adultos.
In the present study, the normative development that has been presented in criminal matters will be analyzed, in relation to minors, with whom it has been tried to comply with the requirements made by the universal system of protection of Human Rights, especially to through the International Convention on the Rights of the Child, adopted by Colombia through Law 12 of 1991; legal principles that were also inserted in the Political Constitution of Colombia, which in its articles 44 and 45 clearly establishes the recognition of rights for children and adolescents and especially develops the best interests of the child as a guiding principle. This legislative evolution led to the creation of Law 1098 of 2006, which contains all the principles and recognition of the rights of children and adolescents, creating a great advance in the protection of fundamental rights of adolescents in conflict with the law, such as due process and right to defense; it also establishes that the process must guarantee restorative justice, be based on being pedagogical, specific and differentiated from the adult system.
