Resumen
En Colombia con el transcurrir del tiempo se han desarrollado diversas políticas que buscan aportar a la protección de los Derechos de los trabajadores, mediante la investigación de las enfermedades asociadas al desempeño de determinadas tareas, su prevención-ocurrencia y la capacitación de los trabajadores para la prevención de accidentes asociados a la realización de las funciones laborales, con el siguiente estudio se hará un recorrido por todas estas normas enmarcadas en el área de la seguridad y salud en el trabajo. Iniciaremos con los antecedentes en Colombia sobre esta temática bajo dos enfoques constitucionales (Constitución Política de Colombia de 1886 y la Constitución Política de 1991), partiendo con la ley 57 “Ley Uribe” de 1904 encaminada al bienestar de los trabajadores, hasta la Resolución 1016 bajo la constitución del 1886. Posteriormente con el cambio de constitución, bajo el amparo de la constitución política de 1991, podremos ver como la ley 100 de 1993 ha sido un pilar fundamental del sistema de seguridad integral reforzada más adelante con el Decreto Ley 1295 de 1994 se define como será la estructura y funcionalidad que tendrá el sistema de riesgos profesionales, garantizando los derechos de los trabajadores a tener un trabajo digno, con la Ley 776 de 2002 se indica la organización , administración y presentación de un sistema general de riesgo profesional ya que induce a que los trabajadores estén afiliados a este tipo de sistema, por estar expuestos a terminar involucrados en un accidente o enfermedad laboral, y al estar afiliados en éste, al presentarse una de estas situaciones obtienen servicios asistenciales.
