Resumen
Esta investigación analiza los choques jurisdiccionales que existen entre la Jurisdicción Especial Indígena y la Jurisdicción ordinaria en Colombia; por ende, se enfatiza en el reconocimiento de la autonomía de los pueblos indígenas y los límites impuestos por la constitución política de Colombia, se incluye su relación con el bloque de constitucionalidad y los derechos humanos. Asimismo, mediante un adecuado estudio de sentencias claves de la corte constitucional y la exposición de casos significativos como el de la mutilación genital femenina en la comunidad Emberá Chami, en la cual se evidencian las implicaciones y tensiones que pueden existir entre ambas jurisdicciones.
This research analyzes the jurisdictional conflicts that exist between the Special Indigenous Jurisdiction and the ordinary jurisdiction in Colombia. Therefore, it emphasizes the recognition of the autonomy of Indigenous peoples and the limits imposed by the Colombian Constitution, including their relationship with the constitutional block and human rights. It also examines key rulings from the Constitutional Court and presents significant cases, such as that of female genital mutilation in the Emberá Chami community, which highlight the implications and tensions that may exist between the two jurisdictions.
