Resumen
Este trabajo es un análisis, de los vacíos normativos del trabajo independiente mediado por plataformas digitales en Colombia, especialmente en contextos de alta informalidad como Cúcuta, donde más del 60 % de los trabajadores carecen de seguridad social y aunado a ello, la migración venezolana incrementa la vulnerabilidad laboral. Ante la falta de mecanismos digitales confiables de contratación, se propone WorkFlex como un modelo conceptual de plataforma orientada a conectar hogares, empresas y personas con trabajadores que ofrecen servicios profesionales y oficios varios mediante contratos electrónicos auditables, trazabilidad de pagos y verificación segura.
La investigación, de enfoque cualitativo y socio jurídico, identifica que, normas como la Ley 2466 de 2025 y la jurisprudencia reciente siguen siendo insuficientes para regular la subordinación algorítmica y las nuevas formas de autonomía digital. El análisis comparado evidencia tendencias internacionales hacia modelos híbridos que garantizan derechos mínimos. Se concluye que WorkFlex podría aportar a la formalización laboral y a un ecosistema digital más justo si se acompaña de regulación adaptativa y políticas públicas de inclusión.
This work analyzes the regulatory gaps surrounding independent work mediated by digital platforms in Colombia, especially in highly informal contexts like Cúcuta, where over 60% of workers lack social security. This situation is further exacerbated by Venezuelan migration, which increases labor vulnerability. Given the lack of reliable digital contracting mechanisms, WorkFlex is proposed as a conceptual platform model designed to connect households, businesses, and individuals with workers offering professional services and various trades through auditable electronic contracts, payment traceability, and secure verification. This qualitative, socio-legal research identifies that regulations such as Law 2466 of 2025 and recent jurisprudence remain insufficient to regulate algorithmic subordination and new forms of digital autonomy. Comparative analysis reveals international trends toward hybrid models that guarantee minimum rights. The study concludes that WorkFlex could contribute to formalizing employment and creating a fairer digital ecosystem if accompanied by adaptive regulation and inclusive public policies.
