“Loot Boxes”, la nueva forma de apuestas online

Resumen
Los juegos de azar son aquellos juegos en los que el hecho de ganar no depende del
jugador en sí. Dependen de la probabilidad y de las estadísticas, estos son los pilares
fundamentales de todos los juegos de apuestas que hay en el mundo. Sin embargo, gracias a
la evolución constante de la tecnología y la masificación de las conexiones a internet, varias
actividades y productos han hecho el salto generacional de innovar en el mundo digital.
Entre todos los avances y productos que trajo el internet existe uno que recientemente
ha generado un debate en varios países europeos por definir que son en su esencia.
La comunidad de internet los nombro «Loot Boxes», que traducido al castellano seria
«Cajas de Botín», y son un sistema de ventas aleatorias dentro de los videojuegos donde el
consumidor no puede decidir qué tipo de contenido tiene dentro del producto sino después
de su compra.
Estas cajas de botín son principalmente una forma de monetización en los
videojuegos. Si las cajas de botín son similares al juego, esto plantearía serias
preocupaciones sobre su libre venta para los juegos para un público más joven.
Mediante los avances realizados por diferentes naciones, y utilizando la hermenéutica
y la analogía jurídica se buscó definir si dentro de la legislación colombiana se puede
categorizar este producto como un juego de azar y ser regulado como tal.
El objetivo de la presente investigación va dirigido a que si estas apuestas se
encuentran reguladas por alguna normativa nacional. En cuenta a población en quien recae
la investigación es a la comunidad gamer.
Games of chance are those games in which the fact of winning does not depend on the player himself. They depend on probability and statistics, these are the fundamental pillars of all the betting games in the world. However, thanks to the constant evolution of technology and the spread of internet connections, various activities and products have made the generational leap to innovate in the digital world. Among all the advances and products that the internet brought, there is one that has recently generated a debate in several European countries to define what they are at their core. The internet community named them "Loot Boxes", and they are a system of random sales within video games where the consumer cannot decide what type of content they have within the product except after your purchase. These loot boxes are primarily a form of monetization in video games. If loot boxes are similar to the game, this would raise serious concerns about their free sale for games to a younger audience. Through the advances made by different nations, and using hermeneutics and legal analogy, we sought to define whether, within Colombian legislation, this product can be categorized as a game of chance and regulated as such. The objective of the present investigation is directed to whether these bets are regulated by any national regulations. The population in charge of the research is the gamer community.
