Resumen
El artículo examina el recurso extraordinario de unificación de jurisprudencia en Colombia, su origen, marco normativo y función dentro de la jurisdicción contencioso-administrativa. Este recurso, establecido en la Ley 1437 de
2011 y modificado por la Ley 2080 de 2021, tiene como objetivo principal garantizar la coherencia y seguridad jurídica en las decisiones judiciales, consolidando el rol del Consejo de Estado como máximo órgano unificador. Se destacan las sentencias de unificación como un criterio vinculante para jueces y autoridades administrativas, enfatizando su relevancia en la uniformidad de las decisiones y en la interpretación del derecho administrativo. El artículo subraya las condiciones y requisitos para la expedición de estas sentencias, así como las dificultades generadas por la falta de claridad en los criterios de relevancia jurídica, económica y social. Este vacío normativo ha ocasionado
interpretaciones dispares y, en consecuencia, una aplicación desigual en el sistema jurídico, lo cual afecta la percepción de equidad y predictibilidad. Además, se analiza el mecanismo de extensión de jurisprudencia, que permite
aplicar los efectos de las sentencias de unificación a casos similares, fortaleciendo la igualdad material y promoviendo un sistema más justo y accesible. Sin embargo, se señala que las deficiencias en la capacitación de los operadores
jurídicos y la ausencia de parámetros homogéneos limitan la efectividad del recurso. Finalmente, se enfatiza que, a través del desarrollo de directrices claras y capacitación especializada, el recurso puede contribuir significativamente
a consolidar la seguridad jurídica y la confianza ciudadana en la justicia administrativa.
The article examines the extraordinary appeal for unification of jurisprudence in Colombia, its origin, regulatory framework, and function within the administrative jurisdiction. This appeal, established by Law 1437 of 2011 and modified by Law 2080 of 2021, aims to guarantee coherence and legal certainty in judicial decisions, strengthening the role of the Council of State as the highest unifying body. It highlights unification rulings as binding criteria for judges and administrative authorities, emphasizing their relevance in the uniformity of decisions and interpretation of administrative law. The article underscores the conditions and requirements for issuing these rulings, as well as the challenges arising from unclear criteria regarding legal, economic, and social relevance. This regulatory gap has led to disparate interpretations and, consequently, uneven application in the legal system, affecting perceptions of equity and predictability. Additionally, the mechanism for extending jurisprudence is analyzed, allowing the effects of unification rulings to be applied to similar cases, reinforcing material equality and promoting a fairer and more accessible system. However, deficiencies in the training of legal operators and the absence of uniform parameters limit the appeal's effectiveness. Finally, it is emphasized that, through the development of clear guidelines and specialized training, the appeal can significantly contribute to strengthening legal certainty and public trust in administrative justice.
