Análisis sobre la efectividad de la justicia en Colombia. La congestión judicial en Barranquilla (2017- 2018)

Resumen
El presente trabajo se propuso como objetivo: Analizar el proceso de congestión judicial que tuvo el sistema judicial de la ciudad de Barranquilla durante 2017 y 2018, lo anterior en el entendido que uno de los problemas que afronta en la actualidad la justicia colombiana, es el creciente apilamiento de procesos muy por encima de la capacidad logística de los juzgados, esto genera no solo lentitud del sistema judicial, sino que promueve la institucionalización de una justicia deficiente, engorrosa y carente de confianza.
El problema de la congestión judicial no es nuevo en Colombia y ha sido objeto de prolífico estudio en el interior de la academia colombiana, existiendo un estado del arte sustanciado y rico en referencias sobre la materia, diversos antecedentes consultados para el desarrollo de la mencionada investigación, dan fe de una problemática de fondo en el funcionamiento de la justicia nacional, puesto a pesar de los esfuerzos del Estado Colombiano para mejorar la situación de los juzgados del país, aún no ha habido una reforma o medida capaz de agilizar la resolución efectiva, diligente y adecuada de causas judiciales, a tal efecto, apelando a una metodología descriptiva con un enfoque cualitativo basado en la revisión documental, la presente iniciativa académica permitió verificar que la jurisdicción de Barranquilla es una de las ciudades principalmente afectadas por la congestión de procesos judiciales, puesto solamente en el periodo de referencia de la presente investigación, se logró demostrar que en la ciudad de Barranquilla existió un apilamiento de aproximados 3mil procesos, cifra que genera preocupación frente al funcionamiento de la justicia en el Distrito, esta situación es preocupante puesto se está promoviendo violaciones de derechos y garantías jurídicas de las partes, terminación anómala de procedimientos y lentitud judicial, generando este último factor la perdida de la confianza ciudadana en la labor prestada por las autoridades judiciales.
The present work proposed as objective: To analyze the process of judicial congestion that the judicial system of the city of Barranquilla had during 2017 and 2018, the foregoing in the understanding that one of the problems that Colombian justice is currently facing is the Increasing stacking of processes far beyond the logistical capacity of the courts, this generates not only slowness of the judicial system, but also promotes the institutionalization of a deficient, cumbersome and unreliable justice. The problem of judicial congestion is not new in Colombia and has been the subject of a prolific study within the Colombian academy, there being a substantiated state of the art and rich in references on the subject, various antecedents consulted for the development of the aforementioned investigation , attest to a fundamental problem in the functioning of national justice, given despite the efforts of the Colombian State to improve the situation of the country's courts, there has not yet been a reform or measure capable of expediting effective resolution, diligent and adequate of judicial cases, for this purpose, appealing to a descriptive methodology with a qualitative approach based on the documentary review, this academic initiative allowed to verify that the Barranquilla jurisdiction is one of the cities mainly affected by the congestion of judicial processes , placed only in the reference period of the present investigation, we were able to demonstrate Since there was a stack of approximately 3,000 processes in the city of Barranquilla, a figure that generates concern regarding the operation of justice in the District, this situation is worrying since it is promoting violations of rights and legal guarantees of the parties, abnormal termination of procedures and judicial slowness, generating this last factor the loss of public confidence in the work provided by the judicial authorities.
