Resumen
Es de conocer que el proceso laboral es un conjunto de actuaciones judiciales y es el medio que se usa en las relacione laborales -tanto individuales como colectivas- entre el empleador y trabajador, con la finalidad de dirimir o solucionar los conflicto jurídicos que se presenten entre las partes intervinientes. Teniendo en cuenta esta noción, cabe precisar que los procedimientos laborales han tenido una evolución debido a las nuevas tendencias que se han presentado, producto de los fenómenos sociales, económicos y culturales, obligando al legislador y al estado social de derecho a implementar políticas y mecanismos que se acomoden a las necesidades que se desprendan en el contexto del derecho laboral procesal.
La presenten reflexión hace referencia al tema; “vicisitudes de la justicia digital en el proceso laboral de los juzgados del circuito de barranquilla a partir de la entrada en vigencia del decreto 806 de 2020” el cual se puede definir, como aquellos procesos en materia laboral que se tramitan de manera virtual por medio del uso de las tecnologías de la información y las
comunicaciones (TIC) dentro de la administración de justicia. O aquel en donde las partes intervinientes usan recursos tecnológicos para hacer uso del debido proceso en las audiencias virtuales de materia laboral.
Una de las características principales que dio lugar a la justicia digital en los procesos laborales, en Colombia, fue el decretado estado de emergencia sanitaria por la pandemia del covid 19, que dio lugar a la imposición de medidas de aislamiento preventivo para mitigar la propagación del virus, por esta razón el sistema judicial colombiano y la justicia laboral se vio obligado a suspender la atención en los despachos judiciales de todo el país. Contexto que llevo a las autoridades judiciales, juzgados laborales, trabajadores-empleadores o partes intervinientes en el proceso laboral a que se desarrollara el uso de las TIC como medio para acceder a la administración de justicia.
It is to be known that the labor process is a set of judicial proceedings and is the means used in the labor relations - both individual and collective - between the employer and worker, with the aim of resolving or resolving legal disputes between the parties involved. Taking this notion into account, it should be noted that labor procedures have evolved due to the new trends that have been presented, as a result of social, economic and cultural phenomena, by obliging the legislator and the social state of right to implement policies and mechanisms that are suited to the needs arising in the context of procedural labor law. The present reflection refers to the topic; “vicissitudes of digital justice in the labor process of the courts of the barranquilla circuit since the entry into force of decree 806 of 2020” which can be defined, Such as those labor processes that are processed in a virtual way through the use of information and communication technologies (ICTs) within the administration of justice, or the one where the intervening parties use technological resources to make use of due process in virtual labor hearings. One of the main characteristics that gave rise to digital justice in labor processes, in Colombia, was the decreed state of health emergency due to the pandemic of covid 19, which led to the imposition of preventive isolation measures to mitigate the spread of the virus, for this reason, the colombian judicial system and labor justice were forced to suspend attention in judicial offices throughout the country, the context that led judicial authorities, labor courts, workers-employers or parties involved in the labor process to develop the use of ICTs as a means of access to the administration of justice.
