La política criminal colombiana en los delitos sexuales cometidos por menores de edad. ¿Es populista?

Resumen
Cualquier definición que se tome como referencia de la Política Criminal, parte de una premisa, debe entenderse principalmente como política del Estado y por tanto de los grupos dominantes por lo que siempre está ideologizada y representa los intereses y puntos de vista de las fuerzas hegemónicas sin por ello
dejar de estar vinculado estrechamente al desarrollo histórico del Derecho, al contenido científico de lo jurídico y de otras disciplinas como la criminología, la filosofía del derecho o la sociología criminal. (Posici et al., 1882). Ahora bien, la violencia sexual es un fenómeno criminal extendido y poco denunciado. Esta puede ocurrir en lugares públicos y privados, dentro o fuera del conflicto armado y puede ser perpetrada tanto por agresores conocidos como desconocidos por la víctima. Así, la violencia sexual puede ser cometida por personas de cualquier edad, género, orientación sexual, etnia, capacidad intelectual o clase socioeconómica. (Viera Valencia & Garcia Giraldo, 2019). El método utilizado fue el enfoque cualitativo y se utilizó la técnica de investigación revisión documental.
