Resumen
El presente documento analiza la Ley 1761 de 2015, también conocida como la “Ley Rosa Elvira Celis” por medio de la cual se tipificó el feminicidio como un delito autónomo y se estableció como elemento subjetivo del tipo penal el ingrediente “por motivos de su identidad de género”; el análisis de corte socio-jurídico se desarrolló con un enfoque cualitativo, a través de un método de interpretación jurídica sistemática que permitió determinar la aplicabilidad del tipo penal de feminicidio en mujeres transgénero a partir del contenido material de la norma estudiada, la jurisprudencia de los altos tribunales y la doctrina especializada en la materia. Por último, se realizaron 5 entrevistas a Jueces Penales del Circuito de Barranquilla y se concluyó que, si bien los sentenciadores están dispuestos a aplicar la Ley del feminicidio en casos de mujeres transgénero, falta mucho camino por recorrer para generar consciencia en todos los niveles de la Rama Judicial para materializar la finalidad de la norma estudiada.

Lastly, 5 interviews were conducted with Criminal Judges of the Barranquilla Circuit and it was concluded that, although the judges are willing to apply the Femicide Law in cases of transgender women, there is still a long way to go to generate awareness at all levels of the Judicial Branch to materialize the purpose of the rule studied.
