Análisis de la responsabilidad del estado frente a la prestación del servicio de salud, en el Hospital San Juan de Dios de Pamplona, N. de S. y Medimas E.P.S.

Resumen
Es necesario resaltar que en Colombia se ha considerado que existe la posibilidad de endilgar responsabilidad a las Entidades Promotoras de Salud (en adelante EPS) y las Instituciones Prestadoras de Salud (en adelante IPS) cuando pueda constatarse que se ha incurrido en una acción u omisión que ha incidido en la producción del daño, como se observará a continuación. (Bravo, 2018); Así las cosas, se hace necesario revisar la responsabilidad del Estado con respecto a estas actuaciones, ya que el este no ejerce control suficiente sobre las entidades prestadoras de salud en Colombia.
La legislación, doctrina y jurisprudencia en cuanto a la responsabilidad por negligencia médica, responsabilidad por ineficiencia de las entidades de salud, surge del Estado como ente de vigilancia y garante de los derechos. Como primera medida surgió el manual de ética médica y luego de la Constitución Política que es clara cuando manifiesta que el Estado responderá patrimonialmente por los daños antijurídicos que le sean imputables, causados por la acción o la omisión de las autoridades públicas. Como podemos observar, el Estado se obliga a estar vigilando a las entidades públicas o privadas, que prestan el servicio de salud.”
Así las cosas, este documento permitió mediante una investigación socio jurídico de carácter descriptivo y cualitativo, visualizar el incumplimiento de entidades como MEDIMAS E. P. S Pamplona y el Hospital San Juan de Dios, examinando las características de la prestación del servicio de salud en estas entidades, con ayuda del estudio de casos y encuestas a la población como instrumentos de recolección de datos.
Además, se realizó una caracterización de la responsabilidad estatal en estos casos, a partir de un análisis documental, normativo y jurisprudencial y la identificación de los elementos del Estado Garante como teoría jurídica para prestación de servicios de salud.

The legislation, doctrine and jurisprudence regarding liability for medical negligence, liability for inefficiency of health entities arises from the State as a watchdog and guarantor of rights; As a first measure, the medical ethics manual arose and after the Political Constitution, which is clear when it states that the State is financially responsible for the unlawful damages that are attributable to it, caused by the action or omission of public authorities. As we can see, the State is obliged to be monitoring the public entities that provide health services”. Thus, this document allowed, through a descriptive and qualitative socio-legal investigation, to visualize the non-compliance of entities such as MEDIMÁS E.P.S., Pamplona and the San Juan de Dios Hospital, examining the characteristics of the provision of health services in these entities with help of the case study and population surveys as data collection instruments. In addition, a characterization of state responsibility in these cases was carried out, based on a documentary, normative and jurisprudential analysis and the identification of the elements of the Guarantor State as a legal theory for the provision of health services.
