Resumen
Esta investigación estudia las ventajas de aplicar el mecanismo de mediación en casos de violencia intrafamiliar en la ciudad de Barranquilla. Los objetivos incluyen la descripción de la doctrina y jurisprudencia sobre la mediación en esos delitos. La metodología aplicada es la cualitativa, se realizaron entrevistas personalizadas, a tres Fiscales de la unidad (CAVIF) Centro de Atención Integral a Víctimas de Violencia Intrafamiliar de la Fiscalía General de la Nación en la ciudad de Barranquilla-Colombia, incluido a su coordinador.
Las entrevistas, permitieron establecer la pertinencia y necesidad aplicar este mecanismo, identificando su relación en la reducción de casos y la reincidencia, se combinó con el análisis de documental a partir de la información de los entrevistados en la identificación de casos exitosos de mediación en otros países como Trinidad y Tobago y en varias comunidades en España.
Se concluye que la mediación en asuntos domésticos debe contribuye a la reducción de esa problemática en ese entorno. Su desarrollo progresivo y la agilidad en el servicio judicial, la convierte en un dispositivo restaurativo no adversarial que pueda resolver las dificultades que se presentan entre las personas en ese entorno. La mediación, es un mecanismo alterno de solución de conflicto que promueve la convivencia pacífica, compromete a las partes involucradas y establece procedimientos efectivos para solucionar problemas, evitando así las instancias judiciales de la justicia retributiva. Su principal objetivo es el resarcimiento de perjuicios, lo que refuerza y la importancia para los agredidos y la sociedad en general.
This research studies the advantages of applying the mediation mechanism in cases of domestic violence in the city of Barranquilla. The objectives include the description of the doctrine and jurisprudence on mediation in these crimes. The methodology applied is qualitative, personalized interviews were conducted with three Prosecutors from the unit (CAVIF) Center for Comprehensive Care for Victims of Domestic Violence of the Attorney General's Office in the city of Barranquilla-Colombia, including its coordinator. The interviews allowed us to establish the relevance and need to apply this mechanism, identifying its relationship in the reduction of cases and recidivism, it was combined with the analysis of documents based on the information of the interviewees in the identification of successful cases of mediation in others. countries such as Trinidad and Tobago and in several communities in Spain. Se concludes that mediation in domestic matters should contribute to the reduction of this problem in that environment. Its progressive development and agility in the judicial service make it a non-adversarial restorative device that can resolve the difficulties that arise between people in that environment. Mediation is an alternative conflict resolution mechanism that promotes peaceful coexistence, compromises the parties involved and establishes effective procedures to solve problems, thus avoiding judicial instances of retributi justice. Its main objective is compensation for damages, which reinforces the importance for the victims and the community in general.
