Resumen
El presente artículo tiene como finalidad evidenciar el desarrollo histórico, normativo, legal
y jurisprudencial de la tipificación del delito de feminicidio en Colombia, haciendo un
paralelo de cómo este delito años atrás fue concebido como un tipo penal secundario y con
igual consecuencia legal al delito de homicidio agravado, con dificultad al dilucidar entre
homicidio y feminicidio como asesinato por el hecho de ser mujer, toda vez que hay
ambigüedad y vacíos normativos cuando se está frente al hecho motivador que da como
resultado la muerte a la mujer y se impute correctamente este delito.
Así también se resaltará que la forma en como ha sido redactado este artículo genera en el
ordenamiento jurídico una serie de trasgresión en los derechos de la mujer, que da como
resultado el incremento del índice de violencia contra ella, así como imputaciones erróneas
o impunidad. Por otro lado, gracias a la evolución normativa y jurisprudencial a partir del
cuatro de marzo de 2015 bajo la sentencia de la Corte Suprema de Justicia se reconoció al
feminicidio como una de las violaciones de derechos humanos más extrema y recurrentes en
contra de la mujer, bajo la necesidad entonces, del derecho nacional e internacional de
amparar esa trasgresión, desigualdad y discriminación por razones de género con formas de
erradicación y prevención, a partir de entonces se modificó para ser reconocido como un tipo
penal autónomo alejándose como perspectiva de fenómeno social y concederlo como un

The purpose of this article is to demonstrate the historical, normative and legal development of the criminalization of the crime of feminicide in Colombia, making a parallel of how this crime years ago was conceived as a secondary criminal type and with the same legal consequence to the crime of aggravated homicide. , with difficulty in elucidating between homicide and feminicide as murder for the fact of being a woman, since there is ambiguity and normative gaps when faced with the motivating fact that results in the death of the woman and this crime is properly charged. Likewise, it will be emphasized that the way in which this article has been written generates in the legal system a series of transgressions in the rights of women, which results in an increase in the rate of violence against women, as well as erroneous imputations or impunity. On the other hand, thanks to the normative and jurisprudential evolution as of March 4, 2015, under the ruling of the Supreme Court of Justice, feminicide is recognized as one of the most extreme and recurring human rights violations against women, under the need then, of the national and international right to protect that transgression, inequality and discrimination on the grounds of gender with forms of eradication and prevention, thereafter it was modified to be recognized as an autonomous criminal type moving away as a perspective of social phenomenon and Grant it as a crime.
