Resumen
La legislación colombiana ha desarrollado una manera de vincular al servicio público a las personas, a través del nombramiento en provisionalidad, con una característica especial y es que es de forma transitoria y supletiva, por lo que no ofrece garantías de estabilidad laboral en el empleo. A pesar de que ello fuese así, la jurisprudencia de las altas Cortes a través del tiempo ha aceptado la existencia de una estabilidad laboral reforzada cuando se den ciertas características o condiciones excepcionales; como una mujer en estado de gestación, una persona que padezca limitación física o cuando se pudiera ver afectado algún principio constitucional del trabajador. Este trabajo busca investigar cuál es esa garantía precisa que le permite a las personas que se vinculen al empleo público, por medio de un nombramiento en provisionalidad, gozar de esta prerrogativa.

Despite the fact that this was the case, the jurisprudence of the High Courts over time has accepted the existence of reinforced job stability when certain characteristics or exceptional conditions occur; such as a pregnant woman, a person who suffers from physical limitations or when some constitutional principle of the worker could be affected. This work seeks to investigate what is that precise guarantee that allows people who are linked to public employment, through a provisional appointment, to enjoy this prerogative.
