Resumen
Los contratos han sido fundamentales en las relaciones comerciales y personales a lo
largo de la historia. Sin embargo, la llegada de los contratos inteligentes basados en
blockchain ha traído una transformación disruptiva en la forma de establecer y ejecutar
acuerdos. En el contexto colombiano de 2023 -2024, donde la economía y tecnología han
evolucionado exponencialmente, la implementación creciente de contratos inteligentes
plantea interrogantes sobre su coexistencia con el marco normativo vigente.
Contracts have been fundamental in commercial and personal relationships throughout history. However, the advent of blockchain-based smart contracts has brought a disruptive transformation in the way agreements are established and executed. In the Colombian context of 2023-2024, where the economy and technology have evolved exponentially, the growing implementation of smart contracts raises questions about their coexistence with the current regulatory framework. This research analyzes the legal, regulatory, and practical implications arising from the interaction of smart contracts with traditional civil and commercial contract laws in Colombia and abroad, assessing the need to adapt the legal framework to promote legal certainty in this innovative form of contracting.
