Resumen
El siguiente trabajo de investigación tiene como propósito dar a conocer la vulneración de los derechos humanos a la que se enfrentan los NNA venezolanos en contexto de migración, fenómeno que en los últimos años ha aumentado considerablemente debido a los factores socioeconómicos y políticos a los que se enfrenta el país de Venezuela. Del mismo modo, dar a conocer las implicaciones que tienen las políticas migratorias internacionales, y si estas focalizan a los menores de edad dentro de sus procesos de planeación y ejecución, considerándolos como sujetos de protección especial. Se realizó con la metodología cualitativa y fenomenológica, la cual promovió la flexibilización de su comprensión permitiendo entender de una manera más organizada la situación real que está enfrentando la población de interés, ubicada en el barrio las Cumbres del municipio de Los Patios, Norte de Santander. Dentro de los resultados, se identificó que los NNA migrantes se encuentran en un estado constante de vulneración de derechos, al permanecer de manera irregular dentro del país, lo cual imposibilita el acceso a los servicios básicos del Estado colombiano, además de que la política integral migratoria no los tiene focalizados para su implementación. Finalmente, se concluye que en las políticas migratorias no se encuentran identificados los derechos de los NNA, aclarando que en la mayoría de países no se encuentran consolidadas las mismas, además si se reconoce la vulneración de los derechos fundamentales como el de la familia, la educación, la salud y la alimentación afectando el sano desarrollo y bienestar.
The purpose of the following research work is to make known the human rights violations faced by Venezuelan children and adolescents in the context of migration, a phenomenon that has increased considerably in recent years due to the socioeconomic and political factors faced by the country of Venezuela. Likewise, to make known the implications of international migration policies, and whether these focus on minors in their planning and execution processes, considering them as subjects of special protection. It was carried out with the qualitative and phenomenological methodology, which promoted the flexibility of its understanding, allowing to understand in a more organized way the real situation faced by the population of interest, located in the neighborhood of Las Cumbres in the municipality of Los Patios, Norte de Santander. Among the results, it was identified that migrant children and adolescents are in a constant state of violation of rights, as they remain irregularly in the country, which makes it impossible for them to access the basic services of the Colombian State, in addition to the fact that the comprehensive migration policy does not target them for its implementation. Finally, it is concluded that migration policies do not identify the rights of children and adolescents, clarifying that in most countries these rights have not been consolidated, in addition to recognizing the violation of fundamental rights such as the right to family, education, health and food, affecting their healthy development and wellbeing
