Resumen
Las tensiones jurídicas en la transcripción de incapacidades se presentan en las dificultades que a las que se enfrentan los trabajadores en Colombia cuando las EPS niegan o demoran la transcripción y el pago de incapacidades médicas. Al traerlo a un enfoque en los derechos fundamentales, estas barreras administrativas afectan el mínimo vital, la salud y la dignidad humana, generando tensiones entre la protección de la intimidad del trabajador y la eficiencia administrativa de las entidades de salud. Las prestaciones económicas que se brindan por enfermedad común, accidente laboral o licencias de maternidad y paternidad cumplen una función esencial en la protección del ingreso y es por esto que su cumplimiento oportuno es una obligación respaldada por los principios constitucionales del trabajo, la seguridad social y el mínimo vital.
Legal tensions in the transcription of sick leave arise from the difficulties faced by workers in Colombia when EPSs deny or delay the transcription and payment of sick leave. From a fundamental rights perspective, these administrative barriers affect the minimum standard of living, health, and human dignity, creating tensions between the protection of workers' privacy and the administrative efficiency of health entities. The economic benefits provided for common illness, work accidents, or maternity and paternity leave play an essential role in protecting income, which is why their timely fulfillment is an obligation backed by the constitutional principles of labor, social security, and the minimum subsistence level.
