La intervención interdisciplinar, determinante dentro del proceso penal colombiano para disminuir los factores de riesgo de la reincidencia

Resumen
Las cifras que reporta el Instituto Nacional Penitenciario y Carcelario INPEC
mensualmente dentro de sus informes relacionado con el índice de reincidencia, reflejan
que el tratamiento carcelario y penitenciario no es eficaz, como también demuestra el
incumplimiento de las funciones de la pena, en especial las de prevención especial y la
de reinserción social. Lo anterior evidencia que en algunos de los sistemas judiciales y
penitenciarios deban realizarse cambios en las dinámicas del proceso penal y su
procedimiento a fin de aportar a combatir la reincidencia, tal como ocurre en el caso
colombiano.
Para que el proceso penal contribuya al cumplimiento de las funciones de la pena, en
especial la de prevención especial se debe priorizar en el tratamiento carcelario brindar un mejoramiento del proyecto de vida de quien comete un delito sobre todo cuando es
reincidente mediante la intervención interdisciplinar adecuada cuando se requiera
durante su tiempo de reclusión, acorde a lo contemplado desde los instrumentos
internacionales en especial, las reglas mínimas de tratamiento de los reclusos.
