La inteligencia artificial en la administración publica colombiana: ventajas y desventajas para una regulación efectiva

Resumen
El uso de la inteligencia artificial (IA) en el derecho, y especialmente en la administración pública, representa un reto en constante evolución, considerando diversas variables que serán abordadas en el presente artículo. En él se analizan los principales desafíos jurídicos que plantea la implementación de la IA en la administración pública colombiana. Para su desarrollo, se examinarán las ventajas y desventajas del uso y aplicabilidad de la IA en la gestión pública, teniendo como base principios fundamentales como la transparencia, la responsabilidad estatal y la protección de datos. Asimismo, se evaluará el marco normativo colombiano en relación con la inteligencia artificial. La metodología utilizada corresponde a un enfoque hermenéutico-jurídico, con carácter cualitativo y documental, dado que la información fue recolectada a partir de la revisión de artículos científicos, libros y normatividad del ordenamiento jurídico vigente. Se concluye que es fundamental minimizar los posibles riesgos que pueden surgir en los algoritmos utilizados por la IA, con el fin de proteger principios esenciales de la gestión administrativa. De esta manera, se podrán aprovechar sus ventajas para mejorar su aplicabilidad y optimizar los servicios que se prestan.
The use of artificial intelligence (AI) in law, and especially in public administration, represents a constantly evolving challenge, taking into account various variables that will be addressed in this article. It analyzes the main legal challenges posed by the implementation of AI in Colombian public administration. For its development, the advantages and disadvantages of the use and applicability of AI in public management will be examined, based on fundamental principles such as transparency, state responsibility, and data protection. Likewise, the Colombian regulatory framework related to artificial intelligence will be evaluated. The methodology used corresponds to a hermeneutic-legal approach, with a qualitative and documentary nature, since the information was gathered through the review of scientific articles, books, and regulations from the current legal framework. It is concluded that it is essential to minimize the potential risks that may arise in the algorithms used by AI, in order to protect essential principles of administrative management. In this way, its advantages can be harnessed to improve applicability and optimize the services provided
