Resumen
Los delitos sexuales, sean de mera conducta, de resultado (como el acceso carnal) admiten
tentativa. Pues el sistema penal solo invita a la consumación y no a que haya exigencia de
modificación del mundo externo en la descripción gramatical del comportamiento vulnerador de
los bienes jurídicos consagrados cómo libertad, integridad y formación sexual.
El presente trabajo pretende analizar la admisión de tentativa de delitos sexuales a través
del estudio de conceptos a cerca de los tipos penales de delitos sexuales, además consideraciones
que han desarrollado doctrinantes-juristas para de ese modo hacer un análisis que sirven de
insumo para la tesis central. Este ensayo, se llevará a cabo por medio de una búsqueda selectiva
en base de datos, con enfoque cualitativo y alcance explicativo, puesto que se centrará en
confeccionar un discurso en base a posturas antagónicas para demostrar que, de superarse el
principio de presunción de inocencia, puede darse algunos casos, aplicar la tentativa es lo más
favorable para el acusado y también que, como ha dejado claro la corte nada impide ese
encuadramiento dogmático cuando se demostró un emprendimiento o comienzo de la ejecución
de una conducta que encaja dentro de la descripción legal de un delito, es decir, una conducta
que cumple con los elementos esenciales del delito establecido en la ley.
Sexual crimes, whether they are merely conduct-related (such as sexual acts) or result-related (such as carnal access), admit attempts. The criminal justice system only encourages consummation, not requiring modification of the external world, in the grammatical description of behavior that violates the legal right of freedom, integrity, and sexual development. This paper aims to present a compilation of concepts about the criminal classifications of sexual crimes, as well as considerations developed by legal scholars and lawyers, thereby conducting an analysis that serves as input for the central thesis: "Yes, attempt is admissible in sexual crimes." This essay will be carried out through a selective search in databases, with a qualitative approach and explanatory scope, since it will focus on making a speech based on antagonistic positions to demonstrate that, if the principle of presumption of innocence is overcome, in some cases, applying the attempt is the most favorable for the accused and also that, as the court has made clear, nothing prevents thisdogmatic framing when an undertaking or beginning of the execution of a conduct that fits within the legal description of a crime has been demonstrated, that is, a conduct that complies with the elements of the criminal type established in the law.
