Alcance en la vulneración de los DDHH en los casos de corrupción efectuados por parte de servidores públicos en Colombia

Resumen
La corrupción es una problemática que afecta a la mayor parte de instituciones en el mundo y
pese a que existen múltiples estudios sobre la corrupción se han enfocado en determinar sus
causas y las soluciones para la misma, desde un punto de vista político, económico, penal y
criminológico, dejando a un lado el efecto que estas prácticas tienen sobre los Derechos
Humanos, sobre todo cuando son efectuadas por servidores públicos, pues al poseer control
sobre grandes grupos generan un mayor impacto en la población, es por ello, que es imperativo
determinar el alcance de la responsabilidad de los servidores públicos como representantes del
Estado colombiano y el poder que ellos ostentan en la administración y control de actos u
omisiones que pueden afectar los Derechos Humanos en un sistema político descentralizado.
Para ello fue necesario el uso de una metodología híbrida de igual importancia secuencial
dividida en dos fases la primera con un enfoque cualitativo centrada en el estudio documental
para esclarecer las pautas que determinan las prácticas corruptas y la segunda fase un enfoque
cuantitativo que desarrolla una variable independiente por medio del método experimental al
extrapolar y adecuar una fórmula prexistente determinando el alcance de la vulneración en los
Derechos Humanos. Permitiendo de esta forma visibilizar los nexos causales de estas prácticas
corruptas en los derechos intrínsecos a la dignidad de las personas que dan como resultado la
identificación de indicadores que sirven como base y mejoren los procesos de control con ello
resarcir el daño causado.
Corruption is a problem that affects most institutions in the world and even though there are multiple studies on corruption, they have focused on determining its causes and solutions for it, from a political, economic, criminal of view and criminological, leaving aside the effect that these practices have on Human Rights, especially when they are carried out by public servants, since having control over large groups generates a greater impact on the population, which is why it is imperative to determine the reach of the responsibility of public servants as representatives of the Colombian State and the power they hold in the administration and control of acts or omissions that may affect Human Rights in a decentralized political system. For this, it is necessary to use a hybrid methodology of equal sequential importance divided into two phases, the first with a qualitative approach focused on the documentary study to clarify the patterns that determine corrupt practices and the second phase, a quantitative approach that develops an independent variable. through the experimental method by extrapolating and adapting a pre-existing formula determining the scope of the violation of Human Rights. Allowing in this way to make visible the causal links of these corrupt practices in the intrinsic rights to the dignity of people that result in the identification of indicators that serve as a basis for improving control processes, thereby compensating the damage caused.
