Resumen
La Ley de Insolvencia para personas naturales no comerciantes en Colombia como Estado social de derecho necesitó un marco jurídico que garantizará orden económico y social justo, incluyendo normativas para atender la insolvencia, la apertura económica y crisis prolongadas que incrementaron los retos para regular y proteger a los deudores. En la metodología se empleó el paradigma histórico hermenéutico enfocado en la interpretación de textos jurídicos y normativa vigente, con enfoque cualitativo que describe la aplicación de este régimen, evaluando las normativas a través del análisis documental de leyes, jurisprudencias y doctrinas relevantes; en los resultados, antes de la Ley 1564 de 2012 se enfrentaba una gran incertidumbre jurídica y riesgo de perder su patrimonio, situación que actualmente cambió.
The Insolvency Law for non-merchant natural persons in Colombia as a social State of law required a legal framework that will guarantee a fair economic and social order, including regulations to address insolvency, economic openness and prolonged crises that increased the challenges to regulate and protect the debtors.
