Problemática del traslado de régimen pensional en Colombia

Resumen
La seguridad social está consagrada en la legislación colombiana como un derecho
fundamental del ser humano, elevándolo al mismo rango que aspectos como la vida
o la educación. En este sentido el Estado, a través de sus instituciones, ha
impulsado mecanismos para garantizar que los afiliados al sistema pensional
puedan obtener beneficios que procuren su estabilidad socioeconómica durante la
etapa madurez e inactividad laboral, en la cual ya el individuo no es capaz de
producir los recursos económicos suficientes para satisfacer sus necesidades
naturales. En este orden de ideas, el presente artículo analiza la problemática
asociada al traslado pensional y el reconocimiento de la pensión de vejez, teniendo
en cuenta las falencias observadas a partir de la falta de información precisa sobre
el impacto que esta decisión pueda tener en los montos que finalmente reciba el
afiliado, pudiendo representar un perjuicio al derecho fundamental reconocido por
la normativa vigente. En consecuencia, se examina el contexto normativo y
jurisprudencial del traslado pensional, a fin de identificar las dificultades más
frecuentes de los usuarios y las reformas planteadas por el Estado para dar
respuesta a estas inquietudes. Por medio de una metodología de corte documental,
se analizan leyes, reglamentos y sentencias de la Corte Suprema y la Sala Laboral
sobre la temática planteada. Los resultados apuntan a que la falta de información
oportuna, precisa y confiable por parte de las Administradoras de Fondos
Pensionales (AFP) atentan contra el reconocimiento de la pensión como un derecho
fundamental. Se llega entonces a la conclusión de que el rol de doble asesoría
podría garantizar de mejor forma este reconocimiento, sin socavar el bienestar del
afiliado.
Social security is enshrined in Colombian law as a fundamental human right, elevating it to the same level as aspects such as life or education. In this regard, the State, through its institutions, has promoted mechanisms to ensure that members of the pension system can obtain benefits that ensure their socio-economic stability during the stage of old age, when the individual is no longer capable of producing economic resources, sufficient to satisfy his or her natural needs. Along this lines, the article analyzes the problems associated with the change to the pension transfer and the recognition of the old-age pension, taking into account the shortcomings observed in the lack of information about the impact if this decision over the amounts that the affiliate finally could receive, which could represent a damage to the fundamental right recognized by law. Consequently, the normative and jurisprudential context of pension transfer is examined in order to identify the most frequent difficulties encountered by users and the reforms proposed by the State to respond to these concerns. Using a documentary court methodology, laws, regulations and judgments of the Supreme Court of the Labor Chamber on the subject are analyzed. The results indicate that the lack of timely, accurate and reliable information on the part of the Pension Fund Administrators (AFP) undermines the recognition of the pension as a fundamental right. It is concluded that the role of double counseling could better guarantee this privilege, without undermining the welfare of the member.
