Resumen
El presente trabajo de investigación se centra en el debate existente en Colombia desde un
enfoque específico en la penitenciaria de Cúcuta el Buen Pastor, sobre la duración de los niños
en las cárceles al lado de sus madres PPL (personas privadas de la libertad), desde el contexto
socio familiar que implica la ausencia de la libertad, según lo instaurado por el art 153 de la ley
65 de 1993, modificada por la ley 1709 del 2014 art 88, el objeto de reflexión para este artículo
se evidenciaría en si cuestiona si realmente se protege el interés superior del menor y de la madre
o es contradictorio, y se presenta una vulneración de los derechos del menor, que en Colombia
aún hay subsistencia de bases sólidas, los menores de edad se le desconocen la protección total e
imparcial en su desarrollo, generando vacíos que ponen en peligro el desarrollo integral de los
mismos, por lo tanto, se plantearan los diferentes puntos de vista, argumentos y consecuencias
que genera esta situación, calculando la efectividad y cumplimiento de la norma. Violando el
bienestar y los derechos de estos menores, otorgando una vida de privaciones y exponiendo a
diversos factores de riesgo, es lo que se busca cuando se mantienen a los menores dentro de los
centros penitenciarios, es preciso aclarar que aunque se le mantiene el derecho a la unión
familiar, es necesario mantener un entorno social, educativo garantizando sus derechos
fundamentales.
This research work focuses on the existing debate in Colombia from a specific focus in the penitentiary of Cúcuta el Buen Pastor., On the permanence of children in prisons with their mothers PPL (persons deprived of liberty), from the personal and family relational condition involved in the deprivation of liberty, as established by art 153 of Law 65 of 1993, as amended by Law 1709 of 2014 art 88, this article is an object of reflection since it is questioned whether the best interests of the child and the mother are protected or, on the contrary, there is a violation of the rights of the child, which in Colombia, even in the presence of solid bases, the minors are unaware of the total and impartial protection in their development, generating gaps that endanger the integral development of the same, therefore we will raise the different points of view, arguments and consequences that this generates. tion, evaluating the effectiveness and compliance with the standard. Violating the welfare and rights of these minors, granting a life of deprivation and exposing them to various risk factors, is what is sought when children are kept inside prisons, it is necessary to clarify that although the right is maintained to the family union, it is necessary to maintain a social, educational environment guaranteeing their fundamental rights.
