Resumen
El presente trabajo de investigación se centra en analizar la nulidad innominada dentro del debido proceso en Colombia, explorando su rol en la protección de derechos fundamentales sin la necesidad de recurrir a la acción de tutela. Se enfatiza en el error de interpretación o error in iudicando por el operador judicial, quien no precisa la diferencia entre nulidades saneables e insaneables, considerando la mayoría de las veces que, al no estar relacionadas por el legislador en el código general del proceso, es motivo de denegar las solicitudes, convirtiéndose en una actuación infundada por mero desconocimiento de los orígenes hermenéuticos de la nulidad. Se analizará la nulidad innominada y su actuación como mecanismo de control interno en los procedimientos judiciales y administrativos, lo que evitaría el uso indiscriminado de la Acción de tutela. Se abordan las implicaciones jurídicas y prácticas de esta figura en la administración de justicia y se proponen recomendaciones para optimizar su aplicación. La nulidad innominada, aunque no siempre explícitamente identificada en las normas procesales, juega un rol crucial en la preservación de los principios fundamentales del debido proceso y en la corrección de irregularidades procesales.
The present research work focuses on analyzing unnamed nullity within due process in Colombia, exploring its role in the protection of fundamental rights without the need to resort to tutela action. Emphasis is placed on the error of interpretation or error indicated by the judicial operator, who does not specify the difference between sane and invalid annulments, considering most of the time that, since they are not related by the legislator in the general code of the process, it is reason for denying the requests, becoming an unfounded action due to mere ignorance of the hermeneutical origins of the nullity. The innominate nullity will be analyzed and its performance as a mechanism of internal control in judicial and administrative proceedings, which would avoid the indiscriminate use of the tutela action. The legal and practical implications of this figure in the administration of justice are addressed and recommendations are proposed to optimize its application. The innominate nullity, although not always explicitly identified in procedural norms, plays a crucial role in the preservation of the fundamental principles of due process and in the correction of procedural irregularities.
