Resumen
El presente trabajo de investigación analiza de forma crítica las consideraciones expuestas por la Honorable Corte Constitucional en la sentencia SU440-2021, de cara la obtención de la pensión de vejez en población transgénero, específicamente la “mujer transgénero”.
Así, desarrollamos un poco el concepto de la prestación económica contenida en la pensión de vejez y los requisitos que actualmente son requeridos para su reconocimiento.
El desarrollo al derecho de la igualdad que una vez fue desarrollado por el máximo órgano de cierre constitucional en sentencia C-410 de 1994, para establecer que las diferencias en el requisito de la edad entre hombres y mujeres para obtener la pensión de vejez era constitucional, es uno de los puntos que se abordan y al cual
se le da importancia, pues en atención a los nuevos paradigmas planteados en la sentencia SU440-2021 frente a la población transgénero, se considera que no es factible desconocer los derechos ya adquiridos por las mujeres transgénero, con la excusa de evitar eventuales fraudes al sistema.
Por lo anterior, centramos este análisis en las consideraciones enarboladas por la Corte Constitucional en la sentencia SU440-2021, donde observamos que indirectamente se ha creado la necesidad de estudiar un nuevo requisito para adquirir pensión de vejez en el régimen de prima media con prestación definida, como lo es “el cambio de sexo”, puesto que uno de los argumentos de la Corte para conceder el amparo deprecado, ordenando el reconocimiento de la prestación económica en iguales condiciones que las mujeres cisgénero, fue el hecho de que la actora: i) se identificaba como mujer y ii) hacia un tiempo que había cambiado el marcador de sexo en su documento de identificación, mutándolo de hombre a mujer.
This research paper critically analyzes the considerations set forth by the Honorable Constitutional Court in judgment SU440-2021, in order to obtain the old-age pension in the transgender population, specifically the "transgender woman". Thus, we develop a little the concept of the economic benefit contained in the old-age pension and the requirements that are currently required for its recognition. The development of the right of equality that was once developed by the highest constitutional closure body in judgment C-410 of 1994,to establish that the differences in the age requirement between men and women to obtain the old-age pension was constitutional, is one of the points that are addressed and to which importance is given, because in response to the new paradigms raised in judgment SU440-2021 against the transgender population, it is considered that it is not feasible to ignore the rights already acquired by transgender women, with the excuse of avoiding possible fraud to the system. Therefore, we focus this analysis on the considerations raised by the Constitutional Court in judgment SU440-2021, where we observe that, in and indirect form, the need to study a new requirement to acquire an old-age pension in the average premium regime with defined benefit has been created, such as "sex change", since one of the arguments of the Court to grant the deprecated protection, ordering the recognition of the economic benefit under equal conditions with cisgender women, was the fact that the plaintiff: i) identified herself as a woman and ii) it had been a while since she had changed the sex marker on her identification document, mutating it from male to female.
