Resumen
El control interno disciplinario en Colombia es un conjunto de mecanismos y procedimientos establecidos dentro de las entidades públicas para prevenir, detectar y corregir conductas indebidas de los servidores públicos. Su
objetivo principal es garantizar que los funcionarios cumplan con los principios, normas y valores que rigen la Función Pública, promoviendo la disciplina, la transparencia y la legalidad en la gestión pública. Este control se ejerce a través de investigaciones y sanciones disciplinarias cuando se detectan faltas, con el fin de asegurar el buen funcionamiento de la administración pública y la protección de los intereses del Estado y la ciudadanía. Por tanto, el propósito de esta investigación es analizar los procesos disciplinarios adelantados en primera instancia contra empleados públicos de la Alcaldía de San José de Cúcuta durante los años 2020-2022. La metodología aplicada en este estudio se fundamenta en el paradigma interpretativo, con enfoque cualitativo, de tipo analítico, y apoyado en la hermenéutica jurídica. Se pudo evidenciar que se presenta un aumento en el número de quejas cada año, y aunque el volumen de quejas gestionadas es alto, la distribución de los casos en distintas fases del proceso revela desafíos, en la agilización y resolución de las conductas, que varían desde faltas administrativas menores (ausentismo laboral), hasta infracciones gravísimas (abuso y acoso sexual). Internal disciplinary control in Colombia is a set of mechanisms and procedures established within public entities to prevent, detect and correct improper conduct by public servants. Its main objective is to guarantee that officials comply with the principles, standards and values that govern the Public Service, promoting discipline, transparency and legality in public management. This control is exercised through investigations and disciplinary sanctions when infractions are detected, in order to ensure the proper functioning of public administration and the protection of the interests of the State and citizens. Therefore, the purpose of this investigation is to analyze the disciplinary processes carried out in the first instance against public employees of the Mayor's Office of San José de Cúcuta during the years 2020-2022. The methodology applied in this study is based on the interpretive paradigm, with a qualitative, analytical approach, and supported by legal hermeneutics. It was evident that there is an increase in the number of complaints each year, and although the volume of complaints managed is high, the distribution of cases in different phases of the process reveals challenges, in streamlining and resolving behaviors, that vary. From minor administrative offenses (absenteeism from work) to very serious infractions (sexual abuse and harassment). Through the identification of complaints, procedural stages and results, it has been possible to understand how this Office managed each case and whether the procedures were adequate in terms of sanctions and legal compliance
