Resumen
En Colombia, el principio de la debida diligencia se empezó a consolidar con la constitución de 1991, y se fortaleció con fallos de la corte constitucional. Este principio ha evolucionado como herramienta fundamental en el marco de la protección de los derechos humanos, especialmente en el tratamiento de delitos de violencia sexual. La Debida Diligencia investigativa, tiene como elementos clave la Celeridad, imparcialidad, exhaustividad y protección de derechos. Del análisis de los expedientes, se vislumbra que por diversos factores, los estándares de la Debida Diligencia, no siempre se cumplen, resaltando la dificultad de la realización del Juicio Oral aplicando el principio de concentración, debido a las dificultades de ubicación, notificación y asistencia de las partes, lo que conlleva a reiterados aplazamientos. Los datos analizados muestran que, aunque existen avances en la aplicación del principio de la debida diligencia investigativa en el Distrito Judicial de Pamplona, persisten desafíos
significativos, especialmente en términos de celeridad y exhaustividad. Lo que refleja la necesidad de adoptar medidas estructurales para fortalecer la capacidad investigativa, reducir las barreras en zonas rurales y garantizar una atención integral y sensible al género para las víctimas. Por los hallazgos, se recomienda como estrategia investigativa incrementar el personal especializado, dotación de herramienta tecnológica, mejorar la gestión y celeridad en los procesos y proteger de manera integral los derechos de las víctimas.
In Colombia, the principle of due diligence began to be consolidated with the 1991 Constitution and was further strengthened by rulings of the Constitutional Court. This principle has evolved as a fundamental tool within the framework of human rights protection, especially in the treatment of sexual violence crimes. Key elements of investigative due diligence include speed, impartiality, thoroughness, and the protection of rights. An analysis of the case files reveals that, for various reasons, due diligence standards are not always met. This highlights the difficulty of conducting oral trials applying the principle of concentration, due to difficulties in locating, notifying, and ensuring the attendance of the parties, which leads to repeated postponements. The data analyzed show that, although progress has been made in applying the principle of investigative due diligence in the Pamplona Judicial District, significant challenges remain, especially in terms of speed and thoroughness. This reflects the need to adopt structural measures to strengthen investigative capacity, reduce barriers in rural areas, and ensure comprehensive and gender-sensitive care for victims. Based on the findings, investigative strategies recommend increasing specialized personnel, providing technological tools, improving the management and speed of proceedings, and comprehensively protecting victims' rights.
