| dc.description.abstract | Esta investigación tiene como propósito analizar los daños y perjuicios derivados del uso inadecuado de las redes sociales, en particular cómo estas conductas afectan la integridad personal y moral de aquellos que han sido afectados, y cuáles son las posibles consecuencias jurídicas para quienes incurran en delitos como difamación, injuria o calumnia en entornos digitales. Asimismo, busca identificar alternativas de solución frente a esta problemática. Para su desarrollo se realizó una revisión exhaustiva de sentencias relacionadas con el tema, las cuales fueron estudiadas a través de una matriz jurídica que permitió interpretar la información y construir una línea argumentativa coherente. Los resultados evidencian la importancia de un uso responsable de las plataformas digitales y muestran que, aunque existen normas que regulan la libertad de expresión en medios electrónicos, persisten vacíos normativos. Por ello, se propone incentivar la formulación de una iniciativa normativa que fortalezca la protección y seguridad de las personas en el ámbito digital. | spa |
| dc.description.abstract | This research aims to analyze the damages and losses resulting from the improper use of social networks, particularly how these behaviors affect the personal and moral integrity of those who have been harmed, and what the possible legal consequences are for those who commit offenses such as defamation, insult, or slander in digital environments. Likewise, it seeks to identify possible solutions to this issue. For its development, an exhaustive review of court rulings related to the topic was conducted, which were studied through a legal matrix that allowed for the interpretation of information and the construction of a coherent argumentative line. The results highlight the importance of responsible use of digital platforms and show that, although there are regulations governing freedom of expression in electronic media, legal gaps still persist. Therefore, it is proposed to promote the formulation of a legislative initiative that strengthens the protection and safety of individuals in the digital sphere. | eng |
