Resumen
El presente trabajo de investigación tiene como propósito llevar a cabo la formulación de acciones afirmativas que se encarguen de promover y de garantizar los derechos a la educación y al trabajo de las personas con discapacidad, siendo empleada una metodología basada en el enfoque cualitativo, en el método hermenéutico y en el diseño de proyecto.
La recolección de datos de esta investigación se establece por medio de la implementación de la técnica del análisis documental, específicamente por medio de la matriz de análisis de normatividad. Estas herramientas de recopilación de información permitieron reconocer cuáles son los lineamientos de carácter legal que tratan la reglamentación del esquema de acceso a la educación de la población con discapacidad, además de aquellos lineamientos normativos que salvaguardan la inclusión laboral de esta población.
Como producto final, buscando que en las empresas privadas de Cúcuta se promuevan acciones afirmativas con un enfoque diferencial sólido y que mejore la calidad de vida de las personas con discapacidad, se crea la estructura teórica que debe dar lugar a un Consejo para la Protección y la Promoción de los Derechos de las Personas con Discapacidad -CPPDPD-. Esta dependencia se encuentra apoyada en el Comité para la Protección Laboral de los Trabajadores con Discapacidad -CPLTD- y en el Comité para la Protección Educativa de los Trabajadores con Discapacidad -CPETD-.
The purpose of this research work is to carry out the formulation of affirmative actions that are responsible for promoting and guaranteeing the rights to education and work of people with disabilities, using a methodology based on the qualitative approach, in the hermeneutic method and project design. In addition to the above, methodologically speaking, this research project bases its data collection process through the implementation of the documentary analysis technique, specifically through the normativity analysis matrix. These information collection tools allowed us to recognize the legal guidelines that deal with the regulation of the scheme of access to education for the population with disabilities, in addition to those normative guidelines that safeguard the labor inclusion of this population. As a final product, seeking that affirmative actions be promoted in the private companies of Cúcuta with a solid differential approach and that improve the quality of life of people with disabilities, the theoretical structure that should give rise to a Council for the Protection and the Promotion of the Rights of Persons with Disabilities -CPPDPD-. This unit, in order to strengthen the rights addressed in this investigation, is supported by the Committee for the Labor Protection of Workers with Disabilities -CPLTD- and the Committee for the Educational Protection of Workers with Disabilities -CPETD-.
