El agotamiento de la conciliación extrajudicial como requisito de procedibilidad en la interposición de procesos monitorios

Resumen
Con el proceso investigativo realizado se propusieron como objetivos, el análisis del proceso monitorio en su ámbito esencial, teniendo en cuenta los elementos que lo categorizan como proceso especial y que difiera de los demás procesos en los que se establece la conciliación como requisito de procedibilidad para dar cabida a demanda judicial, con el fin de dar cumplimiento a los mismos, se realizó un estudio y análisis documental empleando como instrumentos matrices de análisis documental, legal, doctrinal y jurisprudencial; además se examinó qué sucede con respecto al requisito de procedibilidad cuando el demandante presenta medidas cautelares, para lo cual se realizó una matriz de análisis documental, donde se trajo a colación un caso en concreto, emanado mediante auto interlocutorio del juzgado octavo civil municipal de Cúcuta del 25 de mayo de 2018. Como resultados de la investigación, se encontró que hay un vacío de carácter legal, el cual da lugar a situaciones como la mencionada del juzgado octavo, que inadmitió demanda monitoria por no haberse presentado conciliación prejudicial, en esa eventualidad se cumplió con los objetivos en el sentido que se buscaba sentar un precedente investigativo, que sirva de herramienta a todos los agentes en esta clase de procesos para que le den una mejor interpretación a la esencia misma de la norma.
In development of this research process it was set as main objective the analysis of monitory procedure –a judicial instrument created to generate a proof when a person has a debt towards another, but this last does not count on a valid document (execution title), though he or she can demonstrate it through other means, to initiate a sue– in terms of his essential content, considering the elements that characterize it as a special procedure that differs from the others, where out-of-court conciliation (in Colombia, conciliation can be judicial or extrajudicial, it is, in court, during procedure, or out of court, before or after a procedure, it is always directed by one person, called conciliator, unless it is done in court, where there is a judge instead of a conciliator) is established as a proceeding requirement before a sue. In order to accomplish this, it was made a documental study and analysis using documental, legal, doctrinal and jurisprudential analyzing matrixes as instruments; also, it was examined what happens, regarding the proceeding requirement, when the plaintiff presents precautionary measures, for which a documental analyzing matrix was made, where a specific case was studied, produced by the an auto (order) of the Eighth Civil Court of the Municipality of Cucuta on May 25th in 2018. As results for this research, it was discovered that there is a legal vacuum, which allows situations as the mentioned about the Eighth Court, which did not receive –non-admitted– a monitory sue because by not fulfilling the prejudicial conciliation. Then, objectives were reached regarding a big aim that was to set a research precedent, which is useful for all agents who participate in this class of procedure in order to have a better interpretation about the essence of law.
