Resumen
Esta investigación analiza la evolución de las leyes en Colombia sobre la pornografía infantil, explorando cómo se han ajustado para proteger a los menores en el entorno digital. A través de un enfoque hermenéutico, se examinan normativas clave del Código Penal entre 2000 y 2018, incluyendo la adopción del Convenio de Budapest. Los hallazgos destacan, primero, la incorporación de principios internacionales y, segundo, la necesidad de una mayor precisión en la tipificación de delitos relacionados con la Pornografía infantil. Aunque Colombia ha progresado en este ámbito, persisten limitaciones en la sanción de conductas complejas. Se concluye que es esencial continuar adaptando y fortaleciendo el marco legal para proteger de forma integral a los menores en el contexto digital.
This research analyzes the evolution of laws in Colombia on child pornography, exploring how they have been adjusted to protect minors in the digital environment. Through a hermeneutic approach, key regulations of the Penal Code between 2000 and 2018 are examined, including the adoption of the Budapest Convention. The findings highlight, first, the incorporation of international principles and, second, the need for greater precision in the classification of crimes related to digital child exploitation. Although Colombia has made progress in this area, limitations persist in the sanctioning of complex behaviors. It is concluded that it is essential to continue adapting and strengthening the legal framework to comprehensively protect minors in the digital context
