Análisis de la sentencia T-025 de 2004 de la corte constitucional respecto a los casos de violación de derechos fundamentales a la población desplazada víctima del conflicto armado en Colombia

Resumen
El Estado de Cosas Inconstitucional, es una figura jurídica que ha sido objeto de estudio y análisis desde diversas perspectivas, dada su trascendencia y alcance para distintos grupos poblacionales que han sufrido continua y sistemática violación de derechos fundamentales consagrados en la Constitución política de Colombia. El presente artículo tiene como objetivo analizar, basados en la Sentencia T-025 de 2004 emitida por la Corte Constitucional, si se vulneran derechos esenciales de la población desplazada por parte del Estado; cuando dicho acceso está supeditado por las propias autoridades a la existencia de recursos, a que se requiera el rediseño del instrumento para la obtención de la ayuda o a que se defina la entidad responsable de satisfacer dichas demandas cuando aquella que lo hacía se encuentre en proceso de liquidación. Para tal fin, se hizo una revisión bibliográfica con base en publicaciones impresas y digitales de diversos autores que a nivel internacional y nacional se han ocupado de la temática desde diferentes enfoques y concepciones. Los resultados evidenciaron de manera consistente la vulneración sistemática de los derechos fundamentales de la población desplazada por el conflicto interno del país pese a las estrategias, argumentos y argucias dilatorias presentadas por los entes gubernamentales encargados de implementar las políticas públicas por parte del Estado. Se concluye que el Estado de Cosas Inconstitucional, como figura jurídica, coadyuva al remedio de problemas estructurales del país en materia de reconocimiento y satisfacción de derechos fundamentales y constitucionales para grupos poblacionales vulnerables, sin menoscabo a la separación de poderes en un Estado social de derechos.
The Unconstitutional State of Things is a legal figure that has been the object of study and analysis from various perspectives, given its significance and scope for different population groups that have suffered continuous and systematic violation of fundamental rights enshrined in the Political Constitution of Colombia. The objective of this article is to analyze, based on Judgment T-025 of 2004 issued by the Constitutional Court, if essential rights of the displaced population are violated by the State; when said access is subject by the authorities themselves to the existence of resources, to requiring the redesign of the instrument to obtain the aid or to defining the entity responsible for satisfying said demands when the one that did it is in the process of settlement. For this purpose, a bibliographic review was made based on printed and digital publications of various authors who at the international and national level have dealt with the subject from different approaches and conceptions. The results consistently evidenced the systematic violation of the fundamental rights of the population displaced by the internal conflict in the country despite the strategies, arguments and delaying tricks presented by the government entities in charge of implementing public policies by the State. It is concluded that the Unconstitutional State of Things, as a legal figure, contributes to the remedy of structural problems of the country in terms of recognition and satisfaction of fundamental and constitutional rights for vulnerable population groups, without prejudice to the separation of powers in a social State of rights.
